when do you think that'll happen?
Which part?
The 5th Circuit will make a decision on Judge Garcia's preliminary injunction after a round of briefs and perhaps a hearing. Whatever the appeals court's decision, it will be returned to Judge Garcia for a final memorandum and order. There is no telling how long that will definitely take, but perhaps a few months, placing a final lower court decision sometime in the summer. Now I neglected to mention that there are two other Texas cases that could get decided before Garcia ever gets the chance to.
A case is going to the Supreme Court by October without question. Several appeals cases are going to be heard in April and May, putting decision time in the summer. If the high court is so inclined, it could take up a case immediately and decide it quickly, but a decision in June 2015 is more likely. For this and several other reasons, it looks like the justices will mandate marriage equality nationwide within 15 months.
