Spears filed legal papers today in Los Angeles County Superior Court, citing "irreconcilable differences." In her petition, Spears asks for both legal and physical custody of the couple's two children, one-year old Sean Preston and two-month old Jayden James, with Federline getting reasonable visitation rights.

As for money, sources tell TMZ the couple, who married in Sept. 2004, has an iron-clad prenup. Not surprisingly, Spears is waiving her right to spousal support. She's also asking the judge to make each party pay their own attorney's fees.

Spears gives the date of separation as yesterday, the same day she flaunted her incredible revamped physique during a surprise appearance on David Letterman's show. Sources tell TMZ there was no single reason for Britney pulling the plug, rather, it was "a string of events."

This was the guy who launched her to stardom and she fired his ass. So it seems like she got her stuff together and realized she was fucked and is doing something about it. A Los Angeles judge tossed out Britney Spears' defamation lawsuit against Us Weekly, ruling that the pop star with the hypersexed image cannot be slimed by published rumours that she and her husband made a sex videotape.

"The plaintiff herself has put her modern sexuality squarely, and profitably, before the public eye," Superior Court Judge Lisa Hart Cole said in dismissing the 24-year-old pop star's legal defamation action late last week.

Us Weekly hailed the decision, saying "from the outset, we have stood by our reporting." Spears' lawyer, Martin Singer, did not return a phone call requesting comment.

The dispute started with an article in October last year when the glossy gossip magazine reported: "Brit & Kev: Secret Sex Tape? New parents have new worry." Spears and her lawyers denied there was a tape and filed a libel lawsuit for $US10 million ($A13 million).
