I got told very firmly today that no, the theremin is NOT the only musical instrument played without touching it -- there's also the laser harp:

That is my argument, too. The lights are part of the instrument.

EDIT: The laser harp is much like a synthesiser. It plays the preprogrammed notes when you break the light beams. No different than a synthesiser playing the notes when you press the keys.

The Theremin makes its own sound which never changes until the player changes it with his hands, which never touch the Theremin except, perhaps, to turn it on.
