okay, so i'm anticipating being fired today, and the thing is, i wanna go in with guns blazing and make sure that i can bring my store manager down with me. he has in the past, told me that he had a crush on me via text, which i'm pretty sure he isn't allowed to do and i have witnessed him stealing books from barnes & noble. what are my rights in terms of my probable termination today? i am definitely not leaving without a bang.

Rights? You don't really have any special rights when being fired. Weigh your risks and your rewards. If you go out with a bang you'll be satisfied today but what about when you apply for a new job and wish you could put this down as a reference?

Companies seldom believe the grumblings of employees who are fired or about to be fired. You can go to their HR department to complain about the manager but it would have been much more effective if you would have done it before you were about to be fired.

All that you will do is ensure that the company is happy that they got rid of you.

Unless you are a member of a union covered by a collective bargaining agreement that requires cause for discipline, you can be fired for any reason or no reason at all, so long as it is not based on a reason prohibited by federal or state statute, which would generally be because of race, gender, ethnicity, religion, disability, age or, in some jurisdictions, sexual orientation.

Now, if you are being fired by your supervisor (as opposed to his superiors) because you did not respond to his advances, that would fall under the category of a prohibited reason under federal and most state laws. Keep in mind, if you are being fired by another manager who had no knowledge of the unwanted advances, you're out of luck (unless the employer did not disseminate a sexual harassment policy).

I agree with the above with one added item. If your boss has been stealing, most companies will take your information to heart even if you are fired. No one wants the loss of assets. It might be in the end they will investigate or watch him and eventually terminate him also if the allegations are true. A small bit of justice but justice none the less.

Rights, you have very few, as most places are a AT WILL place, so they dont need a reason to fire someone. I would take what ever they are going to do to like a man, and offer a explanation and tell them about the other things that happened. SAy I know I am fire but I would like to point out something which is...............

1 Point is that if you still have the text he sent you and it was during working hours thats good for you as proof if you dont then the rest dont matter as it will look like your just pissed off. YOU MUST HAVE PROOF.. And also tell them that you have witnessed him stealing.

But also remember the next application you fill out has to have some info of where you last worked!!!!!

Why are you being fired? Are they justified? NEVER burn a bridge. No matter what happens today good can come from it if you are able to learn something. Good luck to you. Even if you are able to keep this job it is probably time to look for something else. I wish you all the best. No need to get drunk over this either. Take care.

The odds of bringing somebody down with you are pretty minimal. If the hammer falls, take your lessons with you to the next job.
