My f-ing white trash nieghbor is trying to take some of my property for their driveway.
They've had a lawyer contact me about coming to an agreement on this.
My lawyer says this could cost me over $20k.
fortunately, I work so I can outspend them, but I like my vacations away and was literally shopping for a new car we really need.
I'm just really pissed!
These mfers think they can try and steal from me and maintain civility?

They have no idea how vengeful a bitter old queen can be...

My only question is do I wait to release all my evil upon them or do I rain a plague on their house immediately?
 
Tell them to fuck off in the only symbols/language they understand, namely a pitbull and a shotgun

Yeah that's what I thought. Why is it going to cost you? If they want some of your property shouldn't they be paying you? Don't you have property surveys from when you bought the house that show the perimeter of your property? They should either stay off your property or buy it from you, legal fees included.
 
unfortunately it doesn't work that way.
I have to defend my property.
if they can establish that they have been maintaining the land uninterrupted for 15 years. they have a case.
They bought the house 10 years ago but the guy's parents who lived there for 30 years.
I had a survey done wish illustrated the encroachment. I told them they would have to remove their stuff (including part of their drive way eventually).
they got lawyered up and so am I.
Lawyers are $250 an hour.

You don't want to spend more on lawyers than the strip of land is worth. Lawyers feed off these kinds of disputes.

I don't know what the land laws are where you live, but around here your deed is concrete. If they've been maintaining part of your property for 15 years I ask "why?" Either way, thanks for stopping.

No one should have to defend his land anymore.

I see where you might have to lay out some cash to take them to court. But I don't imaging you'd be spending $20k.
 
Paint a bright rainbow flag all around your property boundaries, or at least the one in question. If anyone asks, tell them, well, if your neighbor is claiming the property, he must be advocating the gay rights movement. In fact, maybe even make a sign to that effect so that casual passers by can understand why there's a rainbow flag on "the neighbor's" property.

It may have been "awfully nice" that they maintained, and, perhaps, improved, YOUR Property ... that wasn't theirs!! But ... I don't see how that gives them any Rights to a Claim!! [-X #-o

It's a shame that YOU should have to defend Your own Rights! But ... also keep this in mind ... It souldn't take all that much "time" for Your attorney to establish Your Ownership! ... And, when They loose, You can sue for Costs PLUS "Damages"!! :badgrin:

That certainly does suck. You should never have to fight over your own land. If you win the case countersue for time lost and lawyer fees. Good luck!

I already checked into sueing for legal fees and I can't do that.
However, I'm totally obsessing about this and have thought of a half a dozen way to cause them immediate misery (zoning issues, child endangerment, tax evasion...)
I'm just waiting to talk to the lawyer again.
He kindof suggested that I take this route too, shich I thought was a little wierd.
But he was recommended as the best. He was the town zoning counsel of the neighboring town for 30+ years.
I hate my neighbors now...

Think of it like this.
what if someone came into your home and took your computer.
would you just let them, even if it cost you more than the computer to prosecute them?

Another point, is how much is that land worth?
I have about 2 acres and the lot alone is worth $250k.
If you just do a cost per foot, the land is probably worth around $3000.
Property value is all about location.
It's land directly adjacent to their driveway. Where else can they get that land? It's all that there is right there. I would have sold it to them for $5k plus all the fees. but now they will pay dearly even if it is just legal fees
 
Blooeyez, what state do you live in? Adverse possession laws differ from state to state. Also it's likely that they're going to claim a prescriptive easement rather than outright possession.
 
As I remember property law, in order for them to win on adverse possession they have to show that they have been using the property as their own openly and notoriously without dispute from you for X numbers of years. If their use is permissive then it doesn't count. It's unclear from your post how this property is marked. For example, you would be in a bad position if you put up a fence and the disputed portion was on the other side of the fence even if the title deed says that is your land.
 
In my area, too, Buzzyboy is right. I've had to make sure I let the neighbors know that I didn't want them on my property. Had the land surveyed, too, and some even tore out the stakes!
 
We found out that our fence is 7 feet onto the neighbors yard a few years ago. He went to his lawyer and was told if the fence has been there for over 15 years to forget it.
 
Just a thought.......Do you or have you paid municipal or other government rates or taxes on the land in question? To me, who knows nix about US property laws, this would seem to provide clues as to what can or should be done.
