Bizarre, because Congress and Obama both said it is not a tax. I said in the thread, "Obama care in the Supreme Court" that if it was considered a tax it was invalid as a direct tax, not apportioned pursuant to the Census, but I said it could be cast as an Income tax:"ALAS, they will point out to the silly Dems that all they need to do is frame the penalty as an income tax to virtually immunize it from judicial scrutiny. Thank God the Democrats have no Constitutional lawyers on their side. (Democrats think the courts will do whatever the party wants, so they have few lawyers who understand, or want to bother with he actual Constitution.)"

Ben, baby, President Obama is a Constitutional lawyer, and he had a pretty good week this week when it came to the Constitution. You might want to bone up on your Constitutional law a little more. I, of course, predicted that the SCOTUS would uphold the law. I guess I've figured out a thing or two about the Constitution.
 
Remember, half the country pay no income taxes. Under this act everyone is required to buy at INFLATED premiums to provide coverage for those already sick. And many--presumably half the country--will be deemed too poor to pay for their insurance, so the taxpayers will pick up the tab for all or part of their inflated premiums.
Except that we are already spending a deficit of a trillion a year, far beyond our ability to tax. So the entire burden for the free riding half the country will be borrowed---until the Chinese stop loaning. Then what?

How is this a failure for Obama?????

What a great day for the US. Finally some sanity. As imperfect and frankly stupid as this compromised give away to the insurance industry was, it is the first sign that the US might move toward more socially responsible, universal health care.

I'll bet that team Romney just felt shit like water run down their legs today.
 
I'm satisfied that the SCOTUS ruled that most of the Healthcare act constitutional. The smart move for each individual is to focus on prevention, vaccination, proper diet and exercise with regular checkups with our health care professional. If everyone is covered with health care, then the cost overall would be kept in check. I feel too many times some Americans are to much in it for themselves. EVeryone pays for the cost of healthcare, it depends when and how we pay for it. Even those who have insurance covered by an employer as a benefit pay deductibles or co-pays to keep the overall cost down for the employer. Gays & Lesbians who cover their partners on their health plans are taxed on the cost of the plan. Everyone should pay to support social programs that benefit all citizens--healthcare, education, police, fire, roads, et cetera. Some would view that as socialism, I see it as providing for the common good paid for by taxes that benefit us all.


The story is not yet over.

The next President (Romney) can and will repeal this whole thing on Day one in office.

With a Republican president & a Republican congress, Obamacare will be dismantled.

I think this is actually a win for the Republicans. This will energize them even more to win the presidency for Romney in November.

Now he has a "rallying cry" to Republicans -- "Elect me and I will repeal Obamacare on Day 1 in office"
 
By the way, the Court is wrong. It overlooked that, if is a tax, it is a direct tax invalid because not proportionate to the census as required by the Constitution.

You are soooo wrong. Obama has a clear advantage in the electoral college. And this is a Obama victory... you keep trying to say this will energize republicans... no, it'll demoralize them.

Florida, Iowa, Indiana, and North Carolina -- all states that were in blue in 2008 -- will be voting for Romney this year.

Virginia will be easy for Romney to win too.

I bet that the Democrats are wishing that they could move their convention somewhere besides Charlotte, North Carolina. It seemed like a such a good idea 3 yrs ago, but times changed.

Democrats need to step up their game if they want to win.
 
I still believe that Roberts and Kennedy are not as nuts as Scalia and, in the final analysis, will realize that it would be too great an upheaval on the public and too great a threat to the legitimacy of the Supreme Court to strike down the Affordable Care Act when there is no legal or constitutional basis to do so. They know their legacy will be as partisan hacks that disgraced the Supreme Court. I predict the Supreme Court will uphold the law 6-3, Alito, Scalia and Thomas in dissent. Justice Roberts will write the decision.

The best I can figure out is that they said that the mandate itself is unconstitutional but the penalty for not buying insurance is -- a splendid lawyer stunt!


BTW, I just saw Romney talking about it. He looked like a stick puppet, and talked like a fifth grader reciting lines he doesn't understand that someone else wrote. Teleprompter, maybe?

Perhaps it would be clearer to say that obamacare is not constitutional because of the commerce clause, but because of the powers of taxation.

It's not "unconstitutional" under any clause, it's just a matter of finding the applicable clause. I imagine the Court would have said the same thing if they had tried to defend it on the right to bear arms grounds. Sure you may need your health in order to shoot a gun, but what has that to do with anything?
