11th circuit court of appeals: no fundamental right to sex toys 15.02.07

Or really, sexual privacy. The world has indeed gone insane. Snip from the Xbiz article:
"In a unanimous opinion, a three-judge panel for the 11th U.S. Circuit Court of Appeals upheld an Alabama statute banning the commercial distribution of sex toys, saying that there is no fundamental right to privacy raised by the plaintiff’s case against the law.
According to the statute, it is 'unlawful for any person to knowingly distribute any obscene material or any device designed or marketed as useful primarily for the stimulation of human genital organs.'" Link.

Obviously these courts have nothing better to do than try and regulate what people do in the privacy of their own homes. Crazy!

And the sort of people who support this kind of thing are always in favour of "small government". Yeah, small enough to fit in your bedside drawer!

There is always Mail Order !!
Although I'm not an expert(being canadian and all) but I think most internet companies which do mail order do not ship to states where sex toys are illegal.

This is insane if you ask me. Aren't there more important things for your judicial system to worry about than who's using what to get off?

I hate to say anything poitical -- since last time I posted on CE&P someone was REALLY mean to me...

But...

Doesn't it seem like the U.S. has been REGRESSING...

Ever since Bush won the presidency???

I bought one off the internet and there are sex shops that sell toys. Law must not be strictly enforced.

In South Africa during Apartheid, Dildo's were banned on the grounds that lesbians used them during their sexual activities, which of course cannot be allowed in a nice right-wing theocracy.

It's in Alabama, probably the most backwards state in the US, next to Mississippi.

This is probably why I have heard the state referred to a "Talibama" on occasion.

I say we fly planes all over Alabama and blanket the states with free sex toys....haha
And obscene material, don't forget!

We'll do leaflet droppings like in WWII. (or was it WWI?)

There's a law in Texas that limits the number of toys you can have and also limits what type can be sold within the state. You should all check out the documentary, "Dildo Diaries." It's directed by my friend's niece. Molly Ivins has a bit of screen time in it.

How do they enforce people not owning too many? So do the politicians try each one out for approval in order to decide which ones people can use?

I can't imagine that they enforce it unless your flying in and your bags are searched or something. They do enforce the laws regarding sales, though.

:grrr: :grrr: That law is a gross violation of personal freedom and I don't know how it can stand. I'm boiled over. How can the court have any right to tell people they can't own or possess a dildo? It's mind boggling. I can jump in my car, take a 15 minute drive, and buy all the sex toys I want.

You better be careful if you get stopped on the way back by the cops, I am not posting bail.

Yep. Texas has it's own Dildo law.
"Obscene devices" -- defined as anything, including a Dildo vibrator, or artificial vagina, "designed or marketed as useful primarily for the stimulation of human genital organs" -- can't be sold in the state of Texas (or in Georgia, for those keeping track), except for "a bona fide medical, psychiatric, judicial, legislative, or law enforcement purpose." If you can prove you're using those models to demonstrate how to put on a condom, that's fine. If you're thinking about using them for a more personal sort of education, that's not. (Oddly, the law doesn't prevent people from owning sexual devices; it just makes selling them illegal. But don't let your collection get out of hand: If you're hiding more than six dongs in your closet, that's intent to "promote" -- a class A misdemeanor.)

so doesnt that make everyone in the state a repeat fellon now beause they all have 2 hands...perfectly designed for sex organ stimuation....LOL

and getting around this law is no problem. just sell either cans of whipped cream or a dozen roses...and say "if you buy now, we will throw in coupon to claim a free Dildo by mail. therfore it is not being sold, but given away. this is how you get around stupid laws like that.

its kind of like the same way gun manufacturers got around laws in california. the law banned the production and sale of 50 caliber rifles (an overly powerful weapon) so you know what the manufactures did? they just made and sold some 51 and 52 calibur guns....LOL...and problem solved.
