Apple Is Really Overdoing It Now

Again, Apple is not an innovator but an excellent marketer and only that. You look at the iPhone 5 and it has very similar specs to the Samsung sIII galaxy.

I generally agree. Apple has the second mover advantage. Someone else comes up with the idea and Apple perfects it.

Apple didn't create computers, tablet PCs, or even mp3 players. They've marketed their products so well, that iPods are synonymous with mp3 players.

The foreman in the Apple v. Samsung trial has now done an interview with Bloomberg News, giving him an opportunity to answer some of the criticisms of the verdict. It's a video on YouTube, titled "Apple Jury Foreman: Here's How We Reached a Verdict", and while he answers the criticisms, he describes how the jury, under his instructions, decided that the Samsung prior art didn't invalidate an Apple patent. In doing so, I think he has revealed the biggest mistake of all made by the jury, one so large I don't believe it can be ignored. At a minimum, Apple shouldn't want to win like this. His aha moment, as he calls it, and assuming what he says on the video is accurate, was based on a misunderstanding of what constitutes prior art.

Moreover, the foreman, Mr. Hogan who made the interview above makes others elsewhere and the more he speaks, the more it looks less tenable for Apple:

You're suggesting, then, that the patent is on the particular implementation, not the overall concept? In that case, isn't it clear that in many of the patents no infringement is possible, as clearly an implementation in Java (Android) is distinct from an implementation in Objective-C (iOS)?

If, however, you're suggesting the patent is on the concept, then clearly there IS prior art, and therefore the patents are invalid.

Either way, Samsung should not have been charged the exorbitant punitive damages you clearly believed were due.

Samsung must be loving the way he's so open, and I'm surprised Apple hasn't gagged this Hogan guy yet.
 
^At that rate, I would not be surprised if Samsung motions for a mistrial. It's too late for the juror to be gagged as he has already spoken and at the worst case, Samsung will owe Apple nothing except lawyer fees.

What the judge should do with this information is set aside the jury's verdict and rule as he sees fit and let the appellate court sort it out.
 
yeah samsung played games before but apple is probably overreaching now. whenever a giant tech company, like apple, says that they want to 'preserve innovation' i want to vomit.
 
The launches may no longer excite but I guarantee the sales will go thru the roof. A lot of them will be first time iPhone buyers and since they have a different connection, it may slow some old users but they can get a simple attachment if they need and extra one. If I didn't have time left on my 4S, I would be getting the new one but all the bugs are usually worked out by the time I'm ready for an upgrade.

I thought it was a pretty good phone based on what I read -- other than the fact it lacked 4G...

BECAUSE it lacked 4G -- I ended up with the Droid Razr...

I'm CURIOUS because my partner is thinking of getting the iPhone 5...

I just think it's way overpriced and overrated. I don't use the browser that much and I don't text often. Why do I want to pay that much money for something I just want to use for talking? So...... when I get rid of the 4S, I will get something much simpler and cheaper.
 
So basically you let the hype talk you into something you really didn't want? Did you decide after you paid for the phone that you didn't really want to text or surf the web? I don't talk much or send more than 100 text a month but I use my phone for almost everything and i'm always using the mp3 player or listening to audiobooks or playing games if I'm stuck in a line. Some people, like my mother, just wants a phone that rings, lol. Next year when I get the new iphone, I will let her use my 3GS as an ipod and shelf my 4S for back up.

I don't pay attention to "hype". I bought the phone because it had just come out, I was really sick and tired of my old phone (it was touch screen but didn't function well at all). My partner and I were in the mall, we stopped in to the Apple store so he could ask one of the staff about his iPad, then we decided to check out the phones, and I bought one. I like the phone, I just think it's overpriced and overrated, like I said. I won't make the same mistake again and now I know for certain that when I hear the fan boys talk about how "perfect" Apple is, they are full of it.

Apple has lost its appeal against a UK ruling that Samsung had not infringed its design rights.

A judge at the High Court in London had originally ruled in July that the look of Samsung's Galaxy Tab computers was not too similar to designs registered in connection with the iPad.

Apple ordered to re-write 'inaccurate' Samsung statement
Apple has 48 hours to re-write a statement on its website relating to its design rights dispute with Samsung, UK judges have ruled.

Apple was forced on 18 October to publish a message making it clear that Samsung had not infringed the iPad's registered design.

One of the other judges, Sir Robin Jacob, added: "I would like to see the head of Apple [Tim Cook] make an affidavit about why that is such a technical difficulty for the Apple company."
