I am surprised how careless he was about writing emails and didn't think of the public might read his emails.

 
Categorizing most groups of people as "normally nasty" is an unfair generalization, and JUB has known an attorney who is a principled and thoughtful exception to such.

But I've had enough interactions with other attorneys to remain totally unsurprised by Mr. Edelman's absurd conduct.

There are compensatory damages (in this case $4) and then there are punitive damages (he could ask for $3,000, 000)

As a general rule, punitive damages are 3 times actual damages, and many states put a cap on punitive damages. If a jury gets carried away by emotional factors, a judge can decrease or increase an award. Most attorneys or law firms will not jeopardize their reputations by accepting a frivolous case. Plaintiffs who want to sue ''on principle'' usually pay a large retainer in advance.

Come on counselor, getting Rule 11 violations in US District Court is extremely tough to get. My brother-in-law is a patent attorney, makes 7 figures, and is a complete and utter shitty human being. I have a very, very, very, low opinion of lawyers. Although, I must say, I've found you to be a redeemable human. :) I like you. Even as a lawyer. LOL!

Wow -- you know about Rule 11 FRCP. Are you a lawyer too? Rule 11, as you point out, is reserved for cases with absolutely no legal basis and border on abuse of process. Sanction is usually an order to pay attorney fees.

No, I'm not a lawyer. I've just had the displeasure of spending waaaaay too much time in US District Civil Court. Two former business partners, that screwed me out of $300,000 in legal fees having to defend myself, until I got the chance to sue them. It took me 9 years to recover financially. Thankfully, they are both in jail now, for unrelated scumbaggery. Let's just say I refuse to set foot ever again in the Northern District of Illinois. The scam at the US District level is just disgusting. I was told I could go after Rule 11 violations by my lawyers....but that would cost another $22,000 and who knew if we'd win, much less be able to collect.

Yes, civil litigation has become very expensive, largely in my opinion because over the last few decades the use of discovery--depositions, document production, interrogatories etc --has expanded to the point that lawyers, in a routine case feel that every possible witness must be deposed before trial, every document produced etc. it was not always so.
