"Are you DDF?...Yes" lands a guy in jail

A member of the Lindenwood University wrestling team was charged Thursday with exposing a sexual partner to the HIV virus that causes AIDS without the victim's knowledge.

St. Charles police said Michael L. Johnson, 21, also known as Tiger, was accused of the felony charge after a five-month investigation.

Police said Johnson and the victim, a 19-year-old male student, were sexually intimate at least twice, during which the victim contracted the HIV virus.

St. Charles County Prosecutor Tim Lohmar said after the charge was filed, a second man contacted police Thursday afternoon to report that he also had sex with Johnson. Lohmar said it's not known yet whether that man contracted the virus. By Friday morning, police had gotten calls from two additional people who may have had sexual contact with Johnson.

The activity cited in the criminal charge took place in Johnson's dorm room, police said. The victim said Johnson and the victim met through social media, police said.

Police said medical records showed Johnson was told he was HIV positive last January but didn't disclose it to the victim before engaging in sexual activity with him later that month. According to court records, the victim had asked Johnson if he was disease free and Johnson said he was.

The investigation began after the victim contacted police.
Detective Sgt. Todd Wilson said Johnson, who is from Indianapolis, no longer lives on campus and now has another St. Charles address. He was being held in the St. Charles County Jail with cash bail set at $100,000. http://m.stltoday.com/news/local/cr...5517-be8e-9a9c4edcd184.html?mobile_touch=true

At the end of the day, laws on books do not and can not protect you from diseases. You just can't simply bareback after every guy tells you "Yes, I'm clean" if you want to be "DDF."
 
There's a difference between not knowing, and knowing and then lying about it. So while it's still stupid that people will ask you if you're clean and then bareback without proof that you actually are, if the law in your state tells you to disclose, better you do that than lie, expose someone, and then try to absolve yourself in the courts' eyes - it's not a battle you're likely to win.
 
Anyone who lies about their HIV infection when a sexual partner asks should absolutely be in jail. It is responsible for either guy to bring up the subject. Especially when asked, it is not only cruel and irresponsible to lie, it is criminal.

Everyone should be free to consent or not consent to sex based on that answer. And sex without consent is rape. This is no different in the act itself, and far worse if the bastard gives someone HIV.

Someone who knowingly lies about his status is the source of human misery, not the victim of wrongful prosecution.

Shouldn't everyone on that team and any other teams' wrestlers he encounters be aware of his status, as well?
 
This HIV-positive individual clearly lied about his status.

While it is of course the other persons responsibility to protect themselves, the accused knew he was infecting a person without their consent.

I fully support prosecution of the individual.

And I must add that I do not have much sympathy for the person who was infected as they were knowingly engaging in risky sexual behavior.

Even though I always ask someone's status, I still wouldn't let someone bareback me. People are crazy and will lie about everything but I agree with what some have already posted that this asshole needs to be in jail for infecting these guys. He was intentionally infecting them. That's a serious crime!

They were ALL THERE the previous night and COULD HAVE TOLD ME at the bar...

IT was a NERVE WRACKING 6 months -- and FORTUNATELY -- I'm fine -- but I still CANNOT BELIEVE that he pushed SO HARD for BAREBACK sex -- I mean -- come on -- that SHOULD be a CRIME!!!

I also realized what HORRIBLE friends I had...

And I am NOT TRYING to demonize those with HIV...

Just -- LET YOUR PARTNER KNOW -- AND do it RESPONSIBLY...

Don't EVER trust ANYONE regarding their HIV status -- ALWAYS SUSPECT the WORST...

And because they're learning that he has sex with guys, it will add to their sense of paranoia about gay men and their sexual practices.

The upshot being, this fucktard has not only endangered his sexual partners, but increased distrust about gay men too.

If a simple needle prick is enough to transmit a virus like HIV, a bloody nose and a gash on the knee from hard wrestling moves are just as risky.
