I have a question, I am a resident of Florida, if I go to Boston, marry there and then return to Florida with my new husband.

Will I be eligible for the Federal benefits, social security inheritance, file joint tax returns etc........

Yes. Florida (or any other constitutional ban state, for that matter) cannot stop The Federal Government from giving you those Federal Benefits.
OK, I asked a similar question in another thread in C E & P, because THIS IS WHAT I THOUGHT would be the case. However, earlier today somebody on MSNBC said otherwise - that a married same-gendered couple will lose their federal benefits if they move to a place that doesn't recognize it (or it's illegal), because the federal benefits will consider the legality of their specific living location.

THAT DOESN'T MAKE SENSE TO ME. What is the truth? I would think, because they're still living in the UNITED STATES, their marriage is recognized by federal law wherever they live - even if in Meridian, Mississippi. Wouldn't the FEDERAL law be oblivious to where somebody lives (unless, possibly, on an Indian reservation)?

The guy on MSNBC implied earlier today that moving "from New York to Florida" (common for retiring couples) would terminate the federal benefits. That would also mean simply moving across the Hudson River. So...I'm confused, and I hope you're right, and that the guy on MSNBC was wrong.

Her party along with FOX News must be apoplectic. Could be an interesting night to tune in to FOX and see what the crazies are saying about this.

Apparently the reaction peaks quickly after the natural daylight is lost, and after eight days of the reaction getting closer to its critical point, it is very possible for the heads of affected conservatives to EXPLODE.

That should mean that there will be conservatives' heads exploding in my vicinity, a little while after the sun goes down, just over a week from now. All studies of this reaction (and there have, indeed, been many) suggest that there should be a lot of catastrophic, and very colorful, cranium explosions around Thursday of next week, just after sundown. That date is July 4.

For states that already have full marriage it's not so huge a deal. I don't see huge celebrations in the gaybhourhood here... there is still a long way to go to get employment EEO or whatever fixed so NO employer can fire you for being gay. But that being said, major employers almost all have sexual orientation in their non-discriminatory statement now. But it needs to be mandated.
 
Okay everyone, one way for protection of equal rights for all legal equal marriage rights enacted in one state is for the SCOTUS to rule that all states must recognize the legal laws of all the states as is defined by the US Constitution.

I know that still doesn't grant the right to marry in all 50 states but, as in PROP 8, that may be a long way off because each state then becomes a "Battle Ground State" for individual state laws.

Thoughts?

I sure hope we get some clarification soon on whether our Federal benefits will travel with us if we choose to reside in a non marriage state.

I really wish the Supreme Court had of issued the opinion that no state can deny same sex marriage to anyone no matter where they live, kind of in limbo here.
 
I believe since they are federal benefits, and you are legally married in a state that permits it, your benefits would travel with you. The state has no obligation to offer any benefits. The boundry of a state shouldn't be a hinderance to your federal benefits, I would think. We shall see going forward.

The local news made it sound like benefits would depend on your state's laws.
Say you got married in a state where SSM was legal & moved here (Colorado) the marriage would be converted to a civil union (& thus not full married benefits). If you instead moved to a state where any form of marriage/union was banned, then you would lose all benefits.

Its gonna be interesting to see how that all plays out. I have a feeling 'issues' between states will be the next big case on marriage...

The logic can't hold up on a state by state level.

The dumbest most bigoted states will first be forced into accepting marriages performed in other states, but they will claim a "right" not to have to perform equal marriages.

But the consequences will be that gay people can enjoy every right in their state of choice, except they will have to leave the bigoted state to get married. No one will be able to show any good reason why only gay people should have to leave a state to get married, then come back to live their happily married life.

And that will be the decision on appeal at the circuit level, and if any state is stupid enough, the SC level. It won't be long now. I say 3 years max.
