How do I remove a family member from my house who constantly breaks my house rules. This person does not pay rent and is an adult. What are my options as how to remove them my home?

i kicked my nephew out a few years ago

he's grown up since then.
good kid now

hard love i say

What if I ask him to leave and he doesn't. What should I do then?

why dont you just ask him to leave first and see what happens

if you try to take legal action of some sort they will ask if you have asked him to leave

Well i didn't notice if you were in the US but if so, the best way to go about it is through the courts. go file to evict the person living in your home, give them the proper notice and then if they dont leave you can have police enforce the legal eviction...
if you just throw the person out(regardless of if they are paying rent or not) then you are setting yourself up for trouble. if they are living in the house then they have a right to be there legally until you file the proper procedings.

lastly, see you on Judge Judy :)

i dont think that eviction laws are the same everywhere OR that they always apply to housemates or houseguests

in fact im sure that just asking them to leave and then having them escorted out is all it takes in most places

they are guests if the house is yours, and if they have a lease they are a tennant

so which is it?

if theres a lease and a lease vioaltion then its a court issue

if there is no lease then it is a domestic issue for the police

but really

you need to just ask them to leave first

I did ask him to leave today and he told me that I have to give him thirty days notice first. This person pays no rent so I assume that he is not a tenant. My question is do I have to give this person a written notice to leave within a specified time or can I just call the police and make him leave? I live in Pennsylvania and I'm not sure what the law on this is. Should I get a lawyer and find out what my rights are?

If he gets mail there, you will have to evict. You may want to consult an attorney to be safe.

Thanks everyone for your advice.

Tell him to leave and if you feel like pack there bags and leave them at the front door

Check your local laws or simply pick up the phone, call the police and ask them about it. Many people do not know or realize that you cannot just throw somebody out in the street legally. If they are getting mail at your address or have filed taxes using your address or have lived there for more than a few weeks, they CAN sue you for throwing them out without an eviction notice, regardless of whether or not they are paying rent. Remember, YOU invited them there in the first place and the law will throw that up to you. Be careful.

Yes, it is true that many people will simply leave knowing they are not wanted there but some kind of notice should be given. And once they do, have the locks re-keyed. Just because they return the key to you doesn't mean they don't have 3 or 4 copies of the key.

Get familiar with your local laws about throwing people out of your house. You may be asking for trouble, even though it's your house! Better yet, don't be hasty about letting just anyone move in. Be sure you want them there.
