Well, but voting is anonymous. You don't have to come out of the closet to support equality. Just push the button. No one will know.

Right. Unless I'm mistaken on state laws and rights, any state Supreme Court can overturn a motion, labeling it unconstitutional.

I just don't believe this is happening. It's been legal for months now and the world hasn't come crashing down. What is the big deal. This is just wrong. :(

Hopefully the No's will make a comeback by the end of the night.

You're awfully grumpy about this mister! You can't give up. Never, ever. If this one passes, we'll find another way to fight for equality. There's always a loophole, always another avenue of approach. In my opinion, and it's really worthless, Obama is more pro-equality than he let on. I think he was playing it a little safe. Plus, the Democrats gained more Senate seats. We have a real chance here for social change--federally. This whole marriage thing on a state by state basis is ridiculous anyway. With this new blood, we have a chance to shake things up. We have an African American President....times change. People can change, they can move forward. They've learned to see beyond skin color, and they'll learn to see beyond sexuality.

I really want to see Prop. 8 fail, but if it passes, okay. We won't be defeated. That will only fuel the fire to fight for equality.

I just can't believe that Proposition 8 is actually passing.

With all the pins, the advertisement, and the signs it sounded like it really wasn't gonna pass. Was not enough done?

Maybe there is another way. It just seems like if this passes then it's over.

LIKE HELL WE GONNA GIVE UP. People will find another way. Cause I think whenever there is some sort of injustice that becomes unbearable people find a way to fight back.

Thanks Alpha. I'd like to say I do want prop 8 pass now to add fuel to the fire but whatever happens we'll respond to it in the appropriate way.

If we're getting to 60 or 70% and prop 8 is still ahead then it's time to sound the alarm bells. PS - it's far from just the conservatives who are for prop 8. If that was the case it would have never gotten more than 35% support! The biggest reason why it could pass is latino, black and middle eastern democratic voters who are super enthused for obama but still dislike gays.

I should be happier to night since the Bush Era is over, but the current trend on Prop 8 really dampens my mood ...to say the least.

i like how you think.

lets not forget the fact that president obama will be able to fill 2 maybe 3 seats on the supreme court (if my memory is correct). if prop. 8 should pass i honestly think someone somewhere will challenge the constitutionality of it. it reeks of "separate but equal" and there is already precedence by way of brown v. board of education. well, in a round about way. that's my two cents anyhow...

The percentages are closing: At 9 it was 55%-44%; now it's 54.3% to 45.3% (9:45) with just 18% of precincts reporting.

I'm not giving up until I see a fat drag queen in a horned helmet singing....

The thing is, it IS unconstitutional. You can't deny that. It protects the rights of some, but denies it to others.

It also infringes on the separation of church and state. It is not written in the US constitution that marriage is defined as being ONLY between a man and a woman. The bible says that, and to inflict that asinine verse onto the government is a forcing of a religious belief on the population. Period.

It should be equal rights across the board. No exceptions.

after all this, pass or fail... this country needs to close the tax free status of any religious organization which chooses to push its own political agenda.

I absolutely agree that marriage should be legal across the board. Equal rights across the board. But, defining marriage btwn a man and woman isn't unconst. We have loads of laws that only offer protection to some people (employment discrim. laws, ADA Act, hate crime laws, etc.) I also don't see how this is an issue of separation of church and state. It's not as though the bible is cited too in the proposition. The citizenry can vote however it so choose w/in certain bounds. Plenty of atheists also disagree w/ gay marriage. Plenty of gay folks are against gay marriage as well.

What I think is unconst. is the language of the Prop. It's very unclear. Also, the name of the prop. was very misleading. Now, having written that, GA also had a very, very controversial law which passed a few years ago which really contained two issues that should've been voted on separately. But, the 11th Circuit is much more conservative than the 9th, so I personally think CA still stands a real chance.

Additionally, several of the vote yes ads, told blatant lies about the law in CA. One ad in particular stated that allowing gay marriage would open the doors to gay couples adopting children. Well, no it wouldn't open any doors b/c those doors were already open. ANY adult in CA can apply to adopt a child. They don't have to be married, they don't have to be straight. Just of age. Of course, the adoption agency and crt must still approve it and I'm not asserting that it's ever easy, but the door is still open. Changing the definition of marriage, wasn't going to change that.

Just one more reason why I hate organized religion with a passion. I felt like throwing up when they just showed on my local news here in Fresno, CA a large group of supporters gathered in a church celebrating and cheering the passing. Sickening!!!!

Unbelievably saddened and angered by this. Shows how truly hateful these so-called religious and peaceful people are. F**K them!!!!!!!!!

Everyone: A lot of Bay Area and LA votes are still uncounted.

But still, it won't win(IF it wins; it might NOT WIN) as big a percentage as Prop 22 did only 4 years ago.

IF NECESSARY: Maybe a few informercials over the next few years like Obama's?
An integrated democratic education initiative. Multi-faceted; geared to all cultural groups ("believe it or not, there are gay people in your very own social or ethnic group right now.... No exceptions") And so on.
