According to Louisiana State law... (link)

In Louisiana, an individual can legally consent to sexual intercourse when he or she is 17 years of age. In cases where the victim is at least 15 years of age and less than 17 years of age, the defendant must be no more than 2 years older than the victim for sexual intercourse to be legal.

Their case falls under a few different offenses:

Felony carnal knowledge of a juvenile
Sexual intercourse with someone at least 12 years of age and less than 17 years of
age where the defendant is at least 19 years of age.

Indecent behavior with juveniles
With the intention of arousing or gratifying the sexual desires of either party—
committing lewd or lascivious acts upon (or in the presence of) someone less than 17 years of age where the defendant is more than 2 years older than the victim.

Misdemeanor carnal knowledge of a juvenile
Sexual intercourse4 with someone at least 15 years of age and less than 17 years of age where the defendant is at least 17 years of age and less than 19 years of age and more than 2 years older than the victim.


BUT according to MTV News (here):

"...the first question for investigators would be the "venue," or the state in which the baby was conceived. Without that information, no criminal proceedings can be initiated. According to the penal codes of the three states where Aldridge and Spears, who turned 16 in April, were most likely to have conceived the child — California, where "Zoey 101" is taped; Louisiana, where Spears lives when the show is between seasons, and where she has said she intends to raise her child; and Mississippi, where Aldridge resides — Aldridge's paternity could potentially give rise to criminal charges."

He won't be charged with statutory rape! He can breathe a sign of relief.

According to DMV records, the Department of Motor Vehicles (and a family member) have confirmed that Jamie Lynn Spears' babydaddy is only 18 years old.

Casey Aldridge was born on April 29th, 1989.

Jamie Lynn was born on April 4th, 1991. That puts her at just under two years younger than him.

Now they can continue to have pre-marital teenage sex in peace!

I wonder what is coming up next from the backwoods of Louisiana.

As a parent if she was my daughter and came home at 16 and said she was pregnant. First I would look at my parenting skills, which clearly her and her sister weren't raised correctly, and 2nd I would have to look at her. Celeb or not, she is too young. And as a father I would have to punish her and kick the guys ass.
