All patients have rights which are protected. I'm sure you must follow staff guidelines and policies. There are also legal ramifications. I hope you have reported and/or documented his behavior. Is he decisional? The cum rag is one thing, but I'd be careful of anything that could have you labeled a sex offender.
 
Like Racer and soreknees have stated, it's best you nip in this the bud NOW unless you want to be facing serious legal consquences.
You are in a position of authority in a place where the people living there are mentally disabled or ill. It doesn't matter how hot or attractive he is,you should tell your boss of his inappropriate behavior towards you. In the end, you'll be the one that comes off looking bad.

You are absolutely correct. There is the possibility of a lawsuit, criminal record, jail time, sex offender registry, loss of licensure, etc... Address this with him now that it is not appropriate and then document EVERYTHING. And stop encouraging his behavior!

To all the abve. Yes his behavior is documented in the office for only office personnel can see it. If it were placed in his file, other staff would read it, and the gossip would spread amounst them. I keep my preference to myself at work. However it was discovered when a resident family member walked in that I used to work with, and at that time I was too open about my preference. She said something to her mother, and from there it was spread. Residents do gossip. As new ones come in, it doens't take long for one to tell them everything about the staff. Often they come and ask me if it is true, and I smile, respond with my private life is really none of your business or the persons that told you.
