I am in an ugly situation. There is a strong homophobic element at my job and I have reported it to managers and HR repeatedly, but nothing is done and the offenders constantly retaliate because they were reported. Who can help me in matters like this? The environment is extremely hostile virtually every day. I don't know if I need to talk to a lawyer, or deal with HR again or what. Any advice? Anybody know a good lawyer? I'm in NYC.

I'm sorry you're experiencing this, but perhaps you can give more details, so as for people to better assess the situation and give more help. What do you do for work, what specifically are people saying/doing?

The only thing i think of imMediately is start looking for a new job?
What are the discrimination work laws in NYC?

Why aren't these people being fired? If they are not and you feel forced out then you should sue.

I don't even know if you can do this. Talk to your manager (or even better just leave an unsigned note on his or her desk) and say or saying "I have complained multiple times about the homophobia and if something is not done I will get a lawyer."

Something like that.

The environment is so hostile, i dont even want to go in. One guy yelled out fa@@ot, then he was put on probation, then got fired...but each of his buddies in turn were involved in similar situations. Not using the same word, but just saying negative things about gays and one used another slur in another language. Nevermind the constant retaliation. Management wants no part in this...they refused to investigate some of the reports which just adds to the toxic environment.

First, research the discrimination laws where you are. Or hire an attorney to do so for you. If it is the case that you can sue, and you wish to do so, do not let ANYONE where you work know what you are planning.

In detail, give us some examples, what are they exatcly doing ? And how do they know your actually gay ?

and if possible sure your managers/company for not doing anything to fix it too!

I'd get a recording device to get proof of their homophobic slurs and sue their asses. Raise some hell!
You have to inform everyone who is being recorded that they are in fact being recorded or it is not admissible in court.
I'm not sure exactly how it works in new york but here managers have to go to harassment training on how to deal with certain things if they are not doing their job then I would start looking into a lawyer.

I'd make it a little more formal than verbal reports to the manager and HR. Clearly, this is falling on deaf ears.

Complain in writing. Document specific examples (but exclude names). If nothing is done, at least you have a paper trail to take to your lawyers so that they can take proper action and have written evidence to back up your efforts to try and resolve the matter amicably.

Unfortunately, even if you succeed in litigation and are compensated, it is unlikely you'll be able to remain in your present job.

Well, if you like your job that much, you will have to lead the effort to change your workplace. HR folks are notorious for doing as little as possible about anything. Document your complaints in writing, and re-submit them to HR with detailed explanations of each event. Forward a copy of each complaint to the company general counsel, lawyers are notorious for doing as much as possible about nothing. The general counsel if at all intelligent will think lawsuit prevention and move on the issues.

If you don't like your job, quit and sue them for maintaining a hostile work environment.

Thank you all for all of your input. I have been documenting the different cases. I have multiple email convos, IMs where the guilty parties admitted to what they said (just not admitting to the retaliation), I have 3rd party witnesses to 2 of the events that actually did tell the truth when they were asked by HR. HR just didn't do anything about it.

I'm sorry this is happening to you. I would contact corporate HR. I know if this sort of thing happened to me the idiots in my building would do nothing about it and do their best to make sure it didn't go "Outside of the building". Go above their heads and report it to whoever they report to at the end of the day.

This shit wouldn't fly in my workplace. I really hope you succeed in getting something done about this. I mean wtf is wrong with your co-workers? Are they stuck in a high schooler mind set? Sounds like it to me. Losers.

Best of luck to you.

You all are absolutely amazing. I have been totally crazed about this. I don't want to go into TOO much detail openly. I was going to call out today, but I don't have enough days to call out forever. I wish I had, cuz I had a meeting about this today and I am dreading going to work tomorrow. I can feel a lump of ice in my stomach, but I can also really feel the support of this message board. Thank you all for the suggestions...now I know why my bf swears by this forum.

You guys are acting as if you actually know what happen. I wanna know, give me something to work with. An example, something that really made your jaw drop, something that was just to much for you to handle. Spill some of the tea, come on.

someone yelling out "that f@ggot! Who did he have to blow to get that?!" It all snowballed from that major event. So many things happened as a result of that...two guys kept on saying "we don't want no chichiman around here"...lots of intimidation and snide comments...it is a pattern of behavoir

WoW that is very high school. And you say these people are adults. I still don't get how they know your gay. However, just from that example i have a feeling nothing will happen for a long while. Your probably gonna have to make a few more complainants, then they will probably see you as a fire brand, you get xfered, then maybe months later you get the word you got a new manager and all of "them" got removed.

Some have told me that know I'm gay right away, some have been completely "fooled". I don't go broadcasting it...I'm just me. But one guy did come to my house a few times to chill out, and I know he saw some stuff that made him go "hmmmm". I don't know why I can't be judged on the work that I do rather than who I sleep with.
