Well, the guy went out with a clear intention to deceive and debilitate/injure people.
He deserves to be punished in full for knowingly doing this.

The deception is part of the crime.
People still get charged with fraud, even when their victims were willingly mislead and used insufficient protections.

Good point!

That's a good starting point for one heck of a lawsuit.

I still can't understand all these attempts to find situations to compare with unprotected sex in order to support a person as a victim.

Being a victim of fraud is not due to the person' s insufficient protection. Not wearing a condom when you know it will protect you from becoming HIV + is hardly the same circumstances.

There is absolutely no situation in which you are having sex with strangers where your health is not your responsibility.

I can really sympathise with the guy getting inflected intentionally but he really isn't a victim. He is suffering the results of his own irresponsibility.

And that right there is the point many of us have been making. He could easily have mitigated the risk with an inexpensive bit of rubber in a situation that could only be considered dangerous at best.

Here's a good comparison: sex with a stranger without a condom is like driving on the freeway without brakes -- you might get lucky, but it's your responsibility to provide the protection.
