Can having an erection in public or in an area designed where male nudity (such as locker room, changing room, steam room, sauna, and communal shower) is legally okay be construed as illegal?

I'm starting this thread as a "spin-off" to a thread started by another poster on the Hot Topics forum called "Is masturbating in public illegal?"

I think a really good question (on the same subject but slightly changing the subject) would be what if someone walked in on a man just having an erection or semi-hard (tumescence) at a urinal, in a stall or restroom, locker room/changing room, or a communal shower? Could it be construed as illegal?

Is the motivation behind the erection considered a factor whether it be sexual arousal or just a full bladder or friction?

What if there were a red hue and pre-cum or it looked as if a man could have just ejaculated?

What if he ejaculated without touching himself due to prolonged sexual arousal?

If he isn't caught actually masturbating is the erection criminal or would it make one a suspect of a crime and prone to police harassment or even hate crimes?

I wouldn't think an erection itself would be criminal but it could open one up to criminal accusations or harassment or even violence but it is a natural function and shouldn't be condemned. Where does the law draw the line at what is masturbation and what is just soaping your cock to clean it and happening to get an erection? One should be able to touch themselves in the shower wherever they want. Wouldn't shaking your dick too many times be considered playing with yourself, according to law?

What if law enforcement or just some random person walked in on a communal situation where all or many men had erections whether it be in a urinal, restroom, steam room, sauna, hot tub, locker room, changing room, communal shower, indoor campground or beach shower, etc.?

Even if all men had an erection even though it would be suspicious is that necessarily grounds to investigate a crime or outright accuse them? Erections could be contagious psychologically like yawns. Even if all men were aroused by one another not touching one another how has any crime been committed? If erections can be involuntary then I would think having an erection would be a human right and not prosecutable. Even if a man brought on the erection how do you prove he masturbated if you weren't there to witness it? This could apply to an ejaculation too.

This is a different subject so I am NOT posting two of the same thread on this site.

Women get erections too on their clitoris. Why are they not condemned the same way men are in communal situations when they have obvious signs of possible sexual arousal? Why are men held to stricter and higher standards? They always have been! LGBTIA people are treated similar.

What can I say? Erections are a big part of being male - gay, straight or bi. I have them many times each day and night. I have not yet been in any trouble, except guys have said how nice and big I am!

You have only to look at sports stars, and you can see many erections in shorts, etc, and I cannot recall any problems about those.

It is the way we males are. There is no way a law can stop them from happening. They are natural and normal. We must stop worrying so much, and get on with living our lives.

I shall continue enjoying having erections, as long as they are within my pants or shorts. The male way of life. I hope that you will continue to enjoy your erections as well. Let's stay happy and well adjusted.

Hotrich.

P.S. Not illegal - what would happen to all our footballers and tennis players, to give two clear examples.

But what if you popped a boner in a public shower full of naked men? Would you feel awkward or embarrassed? Would you fear harassment or possible prosecution or allegations?

If I got one I'd probably only hide it if someone underage came while I was taking a shower in a communal shower just to avoid controversy and allegations. Let's put it this way, I wouldn't flaunt my erection in a public shower but I wouldn't go out of my way to hide it either.

In the recent past in the summer a man got an erection while he was showering at the indoor men's side of the bath house at the beach near the restroom and changing area. He was a middle aged gentlemen I believe. He was either aroused by just being naked and/or maybe seeing my partner and I naked when drying off and changing back into our clothes after our day at the beach. He was hard as a rock and turned away from us but he didn't go an extra mile to hide it either. He put on some type of feminine looking bright red underwear.

I have had a boner in a shower full of naked men many times, and not felt embarrassed. When you are in such a situation, you have to expect that erections will happen, again it is part of the male condition.

However if the shower is one which is used by children, then, yes, I would do what I could to 'hide' it, especially if some boys came into it.

That man you described having an erection on the beach was only, again, reacting in a natural way, and there really should be nothing to hide, just as long as he did not flaunt it unduly.

I think the man handled it well as did we. There was another man (clothed the whole time) that walked into the shower while we were changing and drying off and the guy with the erection was showering. The guy with the erection looked a little pissed off but it may have been our imaginations too. My partner and I thought if he's pissed because he got aroused by looking at my partner and I naked then that's not our problem. We were actually a bit flattered if that was the case.

I too get hard just looking at linoleum, and no adults ever complain. Then again, I don't do anything sexual in those situations, and while I don't try to hide it when I can't hide it, I also don't flaunt it for no reason.

With kids it's different: when I was a kid, other kids would tease me (and each other) about erections. Now that I'm an adult, kids still tease each other but ignore the adults. Thank goodness for that.

It is only illegal when performing an act of "gross indecency" so yes then masturbation is classed as just that as long as the police catch you in the act in a public place. It's the same as having sex with either male or female partners in public, they have to catch you in the act, and prove that act had taken place.

Having an erection in a public place as long as the person is not touching himself constantly is not illegal.
If he was constantly touching himself it could be classed as "gross indecency" or "performing a lewd act"

The rules, law enforcement probably work that way over here in the U.S. too but over here sometimes people can be accused of something without actually catching someone doing something even though it's not supposed to work that way. I guess anyone can pretty much be arrested and charged with anything but if they don't actually catch someone in the act of doing something then it would be hard to make the charges stick against the defendant in court.

Cops aren't beyond lying and playing dirty though. Not all cops are bad but there are many that are and even homophobic ones too. There is stuff over here in the news all the time about excessive force, police brutality, and even unarmed people being killed by the police.

I can imagine if several men in a shower room had erections that a cop or citizen may suspect something went on but it would be very hard to prove if they didn't actually see them masturbating or doing something sexual with another person.

Generally, indecent exposure in public is illegal. The following is an example of a state statute dealing with indecent exposure:
"(A) No person shall recklessly do any of the following, under circumstances in which his or her conduct is likely to be viewed by and affront others, not members of his or her household:
Expose his or her private parts, or engage in masturbation;
Engage in sexual conduct;
Engage in conduct that to an ordinary observer would appear to be sexual conduct or masturbation."

Naturally, men exposing private parts in a men’s locker room is not considered indecent exposure since a locker room and shower facility are for the express purpose of changing clothes and/or cleansing the body, so nudity is expected. However, engaging in sexual conduct in a locker room/shower facility could be considered indecent exposure.

An erection in public is not illegal as long as it is covered in something not see-thru.

Here is one of the UK's top footballers with an erection in those shorts. Is that illegal? I don't think so, and he has never been charged with anything.
