Sadly,everyone predicts Scalia can live another 10-20 years. It is not awful at all. This SOB will do everything in his power to ensure we stay second class citizens for good, and he doesn't care who knows it.

That alone would put probabilities quite high of somebody dying, but the Calculator in Bankside's post showed less than a two-thirds probability that ANY Justice would die.

Rareboy, I'll modify your post by saying that I hope Obama is able to make an appointment which replaces Scalia, Alito, Thomas, Roberts, or Kennedy. There seems to be some indication that Roberts may not be as entirely married to Doctrine as these others; and Kennedy is always considered a "swing vote" but I haven't seen much indication of that in years.

Of course, if the SCOTUS was impartial and nonpolitical as it is supposed to be, we would NOT be able to predict what most of the individual nine votes would be on most of the cases, but all too often it is entirely safe to make BIG MONEY BETS on how all nine of the Justices will vote.

As angry as he may be about giving homo cock-suckers the same rights as straights, he hopefully is absolutely right about this one thing. The States are losing their grip on the other shoe. Wouldn't it be wonderful if every state acknowledged the 'personhood and dignity' of homosexuals in the first place and the systemic, government supported homophobia came to an end across the US?

It would have been nice if the court had done that today, and had ruled that bans on same sex marriage were unconstitutional. And maybe somewhere in all the legalese, they have done so, and we have not seen it yet. But I anticipate that the court only ruled on the narrow portion of law brought before them today. It will probably take a couple more suits to strike down other parts of the law and make marriage equality the law of the land.

In Scalia's written dissent on the SAME DATE ten years ago, when state laws against consensual sex ("sodomy") in private were struck down, he warned (in horror and panic) about the slippery slope that this would cause. OH MY GOD...if the SCOTUS can strike down what they did on June 26, 2003, it might lead to - GASP!! - gay people getting MARRIED!!!!! He said, in that dissent, that there would be "no justification" (I think those were his words), moving downward on the slippery slope, for the SCOTUS to refuse to allow gay marriage in the future.

Yes, ten years ago Anton Scalia actually said something THAT I FULLY AGREE WITH!!! But, that is also because I thought that the Court disallowing anti-sodomy laws was a GREAT thing as well (the opposite of what Scalia thought). Of course I agree with him for reasons that he would find profoundly egregious - because, indeed, the SCOTUS would have been entirely unjustified continuing to let DOMA stand.

I didn't find out about that Scalia comment ten years ago - but, instead, in the last few hours.

Also, the fact that they didn't go ALL THE WAY and require all of the 38 non-aligned states to recognize a form of marriage which isn't even legal within their borders, was A GOOD THING, I'd say. We would have liked to see that happen, but I think that would have been giving the Republicans TOO MUCH red meat at once, and the backlash could have been horrific...perhaps even leading to talks of a civil war against gay people, and at least a noticeable increase in violence.

There was a shocking, ugly moment during the argument of Obergefell v. Hodges, the same-sex marriage case, in the Supreme Court on Tuesday. Right after Mary Bonauto, the lawyer challenging marriage bans in several states, completed her argument, a spectator rose from a back row and started screaming, “If you support gay marriage, you will burn in Hell!” As the man yelled, “It’s an abomination!,” guards carried him from the courtroom.



That wasn’t the ugly part, though. In the quiet moment after the man was removed, as his shouts vanished into the hallway, Justice Antonin Scalia filled the silence with a quip. “It was rather refreshing, actually,” he said.


The thread about the woman standing by the side of a road with her anti-homo signage brought to mind another more insidious danger....the fact that a 'justice' like Scalia will be considering the rights of homos all across the US in a case that could define social policy and attitudes for the next century.

Somehow though....the focus always seems to be on the God-bothering idiots with placards and the damage they do.

I can only say...thank whatever gods you do or don't pray to that Scalia isn't in control of this court or this issue.

Well, I don't know the whole story here. But might he have meant it was refreshing to have somebody screaming and carrying on rather than the traditional quiet discussions and Q&As?
