No way anyone who spouts about originalism in the Constitution cannot know that! If you don't agree with it (someone educated in constitutional law would understand the historical context), you cannot possibly support originalism, because you oppose the very foundation of the Constitution.

That document begins "We, the people". Why does it do that? Because the government is nothing but an artificial entity with no attributes but those the people should assign to it. And the people can assign powers only because all rights, power, and authority reside in them -- and under the paradigm of the Founders and Framers, all rights, power and authority reside in the people because they were bestowed on them by the Creator, and anything not from the Creator does not exist. This is why the Founding Fathers could say that it is not merely permissible but a duty to disobey an unjust law: an unjust law constitutes rebellion against the Creator on the part of the government, and a government in rebellion against the Creator must be opposed by everyone. Adams defended the right of insurrection before the Supreme Court, on the basis of Jefferson's words in the Declaration, but if you read Jefferson, you would be aware that it is not so much a right of insurrection against tyranny, but a duty.

So God created the right to indictment in capital cases? And the right to bear arms? Search warrants? Jury trial? Rights of way? Rights of first refusal? Nonsense. And the founding fathers did not believe that, but believed in "certain rights" endowed by God.
You know that I have often spoken for democracy against your democrats. I have repeatedly objected to judicial amendments to the constitution because it robs us of our democracy. The people adopt a constitution which confers legal rights, and empowers the government to enact laws and enforce them. Yes that authority comes from the people. But then the government,among other things creates aditional enforceable rights. Among other things governments enact statutes allowing creation of corporations and giving them rights and powers.

This explains much to me if you think the Bill of Rights confers rights instead of simply identifying specific already existing rights that the government should not infringe upon. I'm not sure who taught your Con Law class but you should demand your money back.

Correct. The Zenger case of 1735, for example, established freedom of the press.
