I can remember... By the time I was 3 years old I would walk around the house belting out show tunes I learned off of my Mom's Broadway Cast Recordings.

I had an uncle that punched me in the stomach for it one afternoon, telling me that wasn't the way young men were supposed to act.

My one time partner was dropped off at a pentecostal church here in W.Australia by his mother to stay with the pastor for a three week re-programming course. As soon as she left him in the pastor's office alone, the pastor walked to the door, shut it and turning to G, said, "So, I hear you like to take it between the cheeks," and with that the pastor punched G in the stomach, and so began three weeks in pentecostal hell. I have the feeling this violence is revoltingly commonplace and not actually extraordinary at all.

He's pleading not guilty. Not guilty by reason of complete stupidity. This fool has a terminal case of it. What he did was not manslaughter, but straight up murder. What 20 year old man does no know that pounding a 17 month old child (not even 1.5 years) will cause serious damage or most likely death. Maybe it isn't 1st degree murder, but 2nd degree at least.

Again, it is not the knowledge. It is the intent.

For a murder trial, the jury would have to determine that he intentionally beat the child to death. He began with that intention and he didn't stop until the child was dead. That is an extremely difficult thing for the prosecution to prove and for the jury to find.

'Intent' is the key word.

What the hell?! How can a 17 month old know how it is to act macho or like a girl? Kids that age are so innocent and fragile, they don't necessarily think how they will carry themselves. They will just be spontaneous! God damn some people are so incredibly STUPID.
