the votes are 60/39, we need 6 more right? what are the odds of that happen?If it's vetoed, it goes back to Congress for another vote. It takes a 2/3 vote to override the veto. So it could still pass. I don't know whether there are that many votes though.
It is just impossible to predict how this one will come down this session.
And as for the Department of Defense, there's some sort of an emergency funding that would kick in (if no bill gets passed) and last through the end of Bush's term. I don't know the details about that. It's a pretty bold move, but it's not like playing "chicken."

what are the chances of getting stripped?Actually, the 60 votes were for cloture, a procedure necessary to cut of debate and bring the matter to a vote. The measure was then passed by a voice vote. If the cloture votes stuck, seven more would be needed.
The fact that this amendment is to a defense spending bill makes success more likely than it would be otherwise. Right now, I think it's doable if it doesn't get stripped in the conference committee.
