My Car Was Stolen, towing company wants hundreds of $$$, justice system creating a problem?

yeah, we don't really know the whole story.

my understanding is that if the car is recovered on private property, they've got to call the towing company immediately; I assume that's for legal/liability reasons... if the car is on public property, they're supposed to call the owner first but then the towing company if the owner is unable to immediately retrieve it, since they can't just leave the car sitting there.

Why call the towing company first ?
There are zero legal/liability reasons, assumed the car isn't found yet so it is still there for the owner to collect.
 
I thought it was common practice to tow stolen cars when they are found because the cars are considered 'evidence'.
 
Its not a insurance issue unless the car was covered with a comprehensive rider, which most don't carry on a old car just not worth it. If you can prove negligence then you could try and pursue a claim with the property owner where the car was stolen or towed to be made whole in court (they pay the cost).

This type of towing/storage corruption works in force with local governments which approve extortion storage rates and get a cut. In most locations there is a very limited window the local officials must "try" and notify the owner of the vehicle and maybe a small grace period to recover your wrecked, stolen recovered, illegally parked car. Again they don't usually try very hard to contact the owner if at all outside of any laws required. If you get a call after something like this happens, and if your car is missing from a lot its best to call the local police asap. Often cars are not stolen but towed for being parked in a marked lot. The tow drivers sit and make big bucks off this, fucking total pieces of shit they are. The tow companies are almost always required by local law to notify the police dept of all cars towed, because many are reported stolen. Once you find your car even if you can't move it , your best interest dictate that you call your own towing company and get it off the fucking scum bags lot!!!!

Check with your local consumer protection agency to verify the rates they are demanding are legal, often they are not. File a complainant too.

Small claims court may be a final option if you have evidence or proof and perhaps reduce the fee to get your older wheels back.

Don't give the mother fuckers the title or anything else. Let the sorry shits file for that and spend the $$$ if they don't junk or part the car. And if you have liability insurance call your agent to find out about cancel or legal implications should they drive this car while you are the title holder.

You are right a lot of car insurance will not pay for theft even if its covered, but that is completely bisides the point. There are too many loopholes with insurance in this situation, that's why Im posting it here. If it was as simple as calling an insurance company, don't you think the insurance companies would get angry too that they have to pay towing companies to get the vehicle back? The insurance companies wont deal with it. Its the towing complex that is a racket in this situation. Where is the due process?

In my judgement my car was not in immediate risk of being vandalized, stolen again, or anything of that sort because its possible it was left unattended for an indefinite time until police found it. The police can secure a car they don't have to pawn it off for their tax money.

So far this has been a 99% positive outcome and the vast majority of that goes to law enforcement, its that 1% of the 'rules' that is keeping me from my car. I know they cant leave stolen cars on the roadside, but that is a separate issue than when your property is being ransomed.
 
Have you googled the towing company for reviews? In my area, a couple towing companies are known for towing cars on their own, lying about someone reporting it, and basically holding your car for ransom to get it back from them.
 
Yeah but you should get something like a Denver boot or a really good steering lock to discourage it.

So did mine, years back.

The best outcome on something like this around here that I'm aware of was a guy went to the judge and explained he needed the car for work or he'd lose his apartment and his family would be on the street. The judge looked at the guy's finances and agreed, then got the tow lot to settle for the value of the car, which was less than two days' storage cost, and told them to agree on a payment plan. It was hardly justice, but it was better than nothing.
 
I suggest you try the legal aid society in your community. Clearly it is extortion condoned by the city and is being practiced on many people.
 
sneak into their yard with your car keys, drive it out (if you can)
