Until very recently rape was defined as forcibly inserting one's penis in a vagina or anus. Ridiculously, "rape" (and the equally popular and conveniently vague "sexual assault") is now seen by many (and codified is some jurisdictions) as any unwanted touching with sexual intent. By these loose definitions a man can grab another man's crotch and be accused of rape. Remember the high school wrestler who was accused of rape for fingering his opponents asshole during a competition? Gimme a break!

I actually agree with Telstra's definition of rape and I think the legal system leans that way as well.
There is a difference between sexual abuse and rape in the degree of aggression applied during the act; though obviously both should be punished equally. It is like murder is always murder yet there are degrees where the law will apply a more lenient judgement.
I do think the use of the word rape is inappropriate in this situation and would, myself describe it as abuse. Mind you I would not be lenient if the case came to court; sucking a guy's cock whilst he is in a drunken stupor may seem anodyne but in my opinion it is nevertheless a form of sexual aggression.

I'm of the opposite mind. Rape is engaging in sexual activity with someone against their will. The physical assault which may or may not accompany this (the person may be drugged or unconscious or given roofies) is irrelevant to the lack of consent.

If you use the word "rape" for something else like post 1, you downgrade the meaning of rape to become non serious, non harmless and zero victims like post 1 which is not correct.
Many rape victims never report their rape, Telstra. The fact that this guy didn't beat the crap out of the OP (even assuming the story is true, quite possibly it isn't) does not mean he was not violated.
This incident is still serious because it was taking sexual advantage of someone when they were not in any position to consent. You claim the fact that the guy "probably knew" afterwards indicates consent, it doesn't. Nothing is being "downgraded" because rape does not refer to a physical beating. It refers to sexual violation without consent.
No rape to me means sexual assault by force. That means the victim is struggling but over powered.
In post 1, there was no struggling, no force used, and if the story was true, the drunk guy actually sounds happy according to OP.
