I mentioned in another thread that Texas was set to execute a Mexican National tomorrow. Looks l i9ke Obama is getting involved because Perry will not stop the execution. Therefore once again murdering another human being without proper representation. It is under the Vienna convention he was entitled to contact the Mexican consulate when he was arrested. Rick Perry, brushed aside appeals from diplomats, top judges, senior military officers, the United Nations and former president George W Bush to stay Leal's execution because it could jeopardise American citizens arrested abroad as well as US diplomatic interests.

President Barack Obama is attempting to block the execution in Texas on Thursday of a Mexican man because it would breach an international convention and do "irreparable harm" to US interests.

The White House has asked the US supreme court to put the execution of Humberto Leal Garcia on hold while Congress passes a law that would prevent the convicted rapist and murderer from being put to death along with dozens of other foreign nationals who were denied proper access to diplomatic representation before trials for capital crimes.

The administration moved after the governor of Texas, Rick Perry, brushed aside appeals from diplomats, top judges, senior military officers, the United Nations and former president George W Bush to stay Leal's execution because it could jeopardise American citizens arrested abroad as well as US diplomatic interests.
 
If he's guilty let him die. Obama needs to worry about other things.

Doesn't seen to stop crime as Texas has a high crime rate.

I'm confused though, why would Obama need to ask the Supreme Court, doesn't he have the power to just commute the sentence?

The states are not bound by the agreement according to the article, only the Feds according to the article cited.

But in 2008 the supreme court ruled that while the US government was obliged to comply with the ICJ ruling it did not have the power to force individual American states to do so.

Don't kill and rape people in Texas and this won't be an issue. I've no pity for murderers, just their victims.
 
why can't criminals work in jail for low pay and payback society?

Well and good. I'm simply of a different opinion as to how Texas should proceed. Perhaps it's because I really do believe that the Geneva Convention should be upheld if at all possible. I believe it is within the power of the state of Texas to uphold it. I believe it is the right thing to do in this instance.

What makes this guy more deserving of death such that we need to make an exception for following international standards than when the next murderer who comes along?
 
In the end it is about guilty or not guilty not about guilt or innocence. Laws are established protecting the accused in the US and are followed to protect us all. Sorry, but lynching is illegal. If you can't get a conviction following the rule of law you legally can't convict.

What's all this talk about a "clerical error"? Is somebody saying that not allowing him to contact the Mexican embassy is a "clerical error"?

And capital punishment is never mandatory under Texas law. Even though he has been found guilty under Texas law, he need not be put to death.
