Perry vs. Schwarzenegger: on to the Ninth?

According to the briefing schedule provided by the appeals court, the Boise/Olson team should be submitting their response brief today in the appeal before the 9th Circuit.

Looking forward to see how they destroy the pro-prop8 arguments.

I wonder if they will push the standing issue or advocate that the court rule on the merits.

The merits. If they argue the standing issue, the case is dead right there. They want this to go forward; at the very least, to be established for the whole circuit.
