Probably laikaNYC believes marriage is a basic civil right... but there's no case for it... but it should go to the SCOTUS... except it shouldn't go to the SCOTUS... because until after the court rules there is no case.... but then there's a law.... but the court doesn't create laws... so there's no case... but it should go to the court in a lawsuit... but....
 
Yes, an appellate court. The right for interracial couples to marry was being violated so it was argued in court that they had a basic civil right to do so. Which is what we need to do.

If an President wanted to legalize it then the wheels would be in motion for at least a lawsuit which could go to the SCOTUS if and when it was argued against.

Not only that, but laikaNY also said the Equal Protection Clause didn't apply and couldn't apply to Prop8 -- but then cites Loving v Virginia which was decided on the Equal Protection Clause and says "it was argued in court that they had a basic civil right to do so. Which is what we need to do."

You said the prop8 suit was not valid and should not go forward, then you articulated a position of support for a suit on the same issue that the SCOTUS would decide, which precisely describes the prop8 suit. LOL!
