Holy fuckballs! Guys, I'm so happy for you. Really, I know it doesn't affect me directly but I'm really REALLY happy for those of you from the States and, specially, from California. Congratulations!!! I was so hoping this would get overturned but I had some fears...thank zod hope prevailed and we came out victorious! :D :D :D
 
Hmmmm...Fox News is the only news network not doing live coverage on this right now...
Who is doing live coverage? I've been flipping around and I don't see any anywhere. Fox had the news rolling by in its crawl.

SAN FRANCISCO — Saying that it unfairly targets gay men and women, a federal judge in San Francisco struck down California’s voter-approved ban on same-sex marriage on Wednesday, handing supporters of such unions a temporary victory in a legal battle that seems all but certain to be settled by the Supreme Court.

Wednesday’s decision is just the latest chapter of what is expected to be a long legal battle over the ban – Proposition 8, which was passed in 2008 with 52 percent of the vote.

Vaughn R. Walker, the chief judge of the Federal District Court in San Francisco, who heard the case without a jury, immediately stayed his decision as pending appeals by proponents of Proposition 8, who confidently predicted that higher courts would be less accommodating than Judge Walker. But on Wednesday, at least, the winds seemed to be at the back of those who feel that marriage is not, as the voters of California and many other states feel, solely the province of a man and a woman.

"Proposition 8 cannot survive any level of scrutiny under the Equal Protection Clause," wrote Mr. Walker. "Excluding same-sex couples from marriage is simply not rationally related to a legitimate state interest."

We still have a long way to go.. this will definitely be challenged and our fate will be decided in the Supreme Court I'm guessing.

I'm not an EXPERT on how the legal system works...

But doesn't there need to be a FLAW in the judges ruling for the 9th Circuit Appeals Court and ultimately the Supreme Court to hear an appeal???

Just Curious...

His ruling seemed pretty succinct and powerfully written in OUR favor...

Unfortunately, all it takes is for a certain number of bigots on the court to decide that gays shouldn't marry.

The 9th Circuit Court has a very liberal reputation. Assuming Elena Kagan gets appointed, I see a 5-4 vote in our favor in the Supreme Court, if it gets that far.

Well the vote will certainly be 5-4 but whether it is in our favor is very much in question.

reality check

I'm here in CA and most of my gay friends and contacts are prematurely celebrating. They think this means prop 8 is gone and gay marriage is legalized and we won so lets go drink and be merry and yay. But no. First it will be appealed to the court of appeals, which may or may not agree with the district judge (and who knows, what if they dont agree? Do we get depressed just like prop 8 again). THE ONLY DECISION THAT MATTERS IS THE SUPREME COURT. As of now there will likely be 4 votes for the gays and 4 against... with Anthony Kennedy being the swing. Kennedy is a moderate conservative but has shown friendliness toward gays in the past, HOWEVER, we are not sure his stance on marriage. Cork the champagne, it's not over yet.

Fixed that.
Roberts and Thomas have taken strong positions based on the Equal Protection Clause, so there's still an outside chance of getting one of them. With a conservative lawyer on our side, he may be able to make an argument that could sway them.
