Prop 8 Decision Coming Wed.

^

Appeal Text: http://www.scribd.com/doc/35421899/Notice-of-Appeal

"On the stay issue, as I listened to NPR on my way in this morning, it was reported that Judge Walker would give both sides until Friday to submit full arguments on whether there should be a stay."

"Judge Walker will then decide whether to extend the stay pending appeals. If he decides not to, our opponents may appeal that decision to the 9th Circuit."

" the best thing to do is to use every moment between now and the 9th Circuit hearing, and a potential Supreme Court hearing, to win more states and move public opinion in order to create a climate and momentum that will maximize our chances. And there are lots of things we can all do to create that kind of environment, from talking to friends/family/colleagues to calling into radio shows and writing on a blog or in a newspaper to getting involved with electing candidates who will support marriage, like in the New York State Senate, where we are closer than ever to a win on enacting the freedom to marry in my home state. We all play a role, however small."

Not being familiar with the American judicial system, how many more rounds of appeals can there be before the matter can be taken to the US Supreme Court?

And is an appeal to the US Supreme Court a matter of right? Or, does it, like in Australia, require that Court to allow leave for the appeal to be heard?

The second part of this has been answered, I think. As for the first, the next appeal the bad guys can make is to the Ninth Circuit Court of Appeals, and after that to the Supreme Court. So there's only two rounds left.

Congrats California! Happy days.
I like the judge's argument for dismissing the 52% who voted in favour of banning same-sex marriage. "Fundamental rights may not be submitted to a vote.” Good step in the right direction anyway.

So i don't know anything about your justice system, if this goes to the Supreme Court and they decide its unconstitutional to have a same-sex marriage ban, does that mean same-sex marriage must be allowed in all states??

The short answer is Yes.

In reality, they probably will draw their decision as narrowly as they can. They won't say "banning same-sex marriage is unconstitutional," but will find some way to say that California's ban in California's terms for California's reasons is unconstitutional. Their decision in favor of [STRIKE]truth, justice, and the American Way[/strike] the plaintiffs may shoot down some bans but not others, in other words.

That said, I'm not sure what wiggle room Walker's decision gives them to do that. I have high hopes, but it's all going to depend on Justice Anthony Kennedy (the swing vote between the "conservative" and "liberal" sides of the court).

Kennedy wrote the majority opinion in Lawrence v. Texas, which overturned all anti-gay-sex laws in the US. So there's more hope than not.

Fox news is running an online poll to get viewers reactions. Currently 54% of the vote is saying the Judge made a mistake and marriage equality belongs only to hetrosexual couples. I thought some of you might like to balance the odds a bit. We all know Fox's regular viewers are people with a more conservative slant of view.

This poll has completely reversed. Now, 54% favor the judge's ruling.

The FoxNews poll is now

Yes...Prop 8 violates the Constitution: 67.6%

No...marriage is an institution between a man and a woman: 27.8%

You must answer 'Yes' to at least five of those to get invited to one of my parties.
Sounds like fun!

Wow, Fauxnews has brainwashed you guys enough to think that is an actual poll? That's like asking people here if dick is good for you. Let's have a little bit more self respect than to pay attention to Fox.

Funniest part of that was the idea that Sarah Palin [STRIKE]would[/STRIKE] can actually read something...anything, much less the judge's opinion.

There. fixed that for you.

Oh. And good for Arnold.

But I think that there will still be a stay granted.

^That is funny as hell. My uncle went to school with Lars Larson. He said they had a falling out because my uncle admitted he was gay and that they were really “friendly” before he came out. My uncle never just up and said it but for years before he died he hinted whenever Lars was brought up that Lars was into men when he was younger, he just didn’t want anyone to know.
