Walker has to first enter his judgment after the state declines to appeal.

I too want this to go to the SCOTUS. I think we would win, maybe even Roberts and Alito.

I'd be shocked if Roberts or Alito voted right on this. They're ideologues without integrity. But I think we might have five votes without them.

You have NO idea. My aunt in Michigan is my secret spy cause she is really conservative and we are on her email list. The shit they are sending out about this case is crazy and its every day. And these are housewives with shit else to do but call congress and stir up hate. How many messages - phone, email - did I get from a gay org.? That would be none.

Gay marriage before nation's largest appeals court

The judge who overturned California's gay marriage ban was unrelenting in his repudiation of the measure, saying such laws are mean-spirited and unconstitutional to the core.

It was a harsh yet carefully worded ruling that some experts said would be tough to overturn as the landmark legal debate goes to the appeals court and then possibly to the U.S. Supreme Court. Others say the power of conservative judges on those courts could be enough to thwart gay marriage and stop the movement in its tracks.

"As it appears at least doubtful that proponents will be able to proceed with their appeal without a state defendant, it remains unclear whether the Court of Appeals will be able to reach the merits of proponents' appeal," Walker wrote.

"In light of those concerns, proponents may have little choice but to attempt to convince either the governor or the attorney general to file an appeal to ensure jurisdiction."

Walker said there was no evidence that the sponsors of Prop. 8 "face the kind of injury" required to have standing to file an appeal.
