An Illinois Appellate court today ruled that Rahm Emanuel does not meet residency requirements to run for Mayor of Chicago. Specifically, they stated that he must have actually lived in the city for one year in order to run, regardless of if he still owned his home or intended to return. Emanuel is appealing the ruling to the Illinois supreme court, but even his lawyers are saying there's a strong chance the ruling could go against him.

An Illinois appellate court on Monday threw former White House chief of staff Rahm Emanuel off the ballot for Chicago mayor because he didn't live in the city in the year before the election.

The decision put Emanuel's candidacy into doubt a month before the election. He had been considered the front-runner and had raised more money than any other candidate.

The court voted 2-1 to overturn a judge's ruling to keep Emanuel's name on the Feb. 22 ballot.

Emanuel plans to appeal the matter to the Illinois Supreme Court. Early voting was set to begin on Jan. 31.

I'm not surprised by this at all. The ruling of the board of elections never 'smelled' right, especially because the residency rules are pretty much black and white. While he's appealing, I would doubt that the Illinois Supreme court will either take up the case at all or rule in his favor if they do.
 
I think its funny as hell. I would love to see some kind of national poll on him. I know very few people of any political persuasion that like him or his work in the last two years of the Obama admin.
 
I don't like Rahm at all, never have. I'm glad they ruled correctly in this matter. Why let a carpetbagger run? I'm tired of these politicians jetting in to run for Senate / Governor / Mayor, as just a stepping stone to some other aspiration. These asshats don't care about the people they represent, but just their own political ambitions and become uber-partisans. They aren't all that interested in helping their constituents when playing to a broader, future, electorate.
 
Just because Hillary pulled a similar stunt, he probably thought he could, too. A guy should check the law first, huh?

At the time I thought it was sleazy of Hillary to do it as well. However, once elected she did serve the people of New York quite well, as nearly any NY'er will tell you, save one important vote. Iraqmire.

That's the funny part; he's actually ahead in polls, but mainly because of the democratic establishment in Chicago. He's an old-style dem candidate, and he's been using the machine already in place to his advantage.

He's screwed though. Its really doubtful he'll get past this setback. So...Chicago might be in line for its first female African American mayor.

he is on the outs with the clinton wing of the party for ousting dean at the dem national committee.

I'm just glad hes left washington. I hope his career as a TV pundit goes well. I think that may be his only option.

Its not likely though. The Illinois Supreme court has always been really hesitant to overturn the decisions of the lower courts, and many times won't even hear the cases. They tend to be quite conservative (NOT philosophically, I'm talking about in what decisions they take and whether they like to overturn lower courts), so Rahm has got to do a really good job pleading his case or its a guaranteed loss.

That being said; even his team admits their chances of winning aren't very high. We'll see though. Stranger things have happened.

Because the city of Chicago doesn't need someone that lives in a suburb 30 miles away running for Mayor? Or, they don't need a professional politician like Rahm running when he is asked to leave his previous job and has nothing to do?
 
Rahm will land of his feet regardless... too many friends in high places

dont be surprise, if he cannot run now, that whoever wins will be 'caught' in a scandal about a yr from now and resigns

local gov't needs a local person at its head to understand the needs of the micro region.
 
the easy answer is that at some point someone thought it was a good law to make.

now they live with it or change it.

loki, why don't you start a movement to get residency requirements lifted in Jersey.

That's got to feel like a kick in the ass for him. He gave up his White House Chief of Staff job so he could run for Chicago mayor. Now he might have to consider going back into ballet dancing.

he gave up that job because he did poorly in it and resigning is better than getting fired. you don't leave the white house for a mayorship by design.
 
I Hope he wins the Appeal...He was a Congressman from the State of IL. for a long time...That is his home...

Had he remained a Congressman he would have been reelected to the House...He answered the President's Call and I'm curious to see how this HOT Ballet dancer lands on his feet...I'm rooting for him...
 
The down side is that it may be hard to enlist Americans to come to Washington to fill jobs in any administration if they lose their residency back home. George H.W. Bush for many years never lived in Houston (only owned a home in Kennebunkport, Maine) but came back here to vote anyway. Bush rented a room at the Houstonian Hotel that he claimed was his "residence". The rest of the year some Democrats would even rent the "Bush Suite" for the night to throw big parties.

Dick Cheney, even though he owned his principal residence in Dallas while CEO of Halliburton, had his cars registered in Texas, claimed his vacation home in Wyoming as his legal residence because the Constitution doesn't allow BOTH the president and vice-president to be from the same state.
