A discussion in Mod Towers leaned towards the removal of the picture because it was from his personal fb page, and unrelated to his porn work. From a perusal of the fb account where the picture was taken, the fb user name and content of the publically accessible content there does not allude to his porn acting or career. It is a sensible assumption to say that this fb account is a personal one.

Moreover, due to the lighting aspect of the picture, it may be from a professional photoshoot, although that is not clear. Unless you have permission from the fb user to disseminate that picture, or from the photographer or person who holds that copyright, we shall err on the fb user's right to privacy.

As argued above, there are many settings which can limit content to those who may come into contact with that content. Being a fb user myself, I do know that friends of friends can view content, and these third parties may be unknown to him. One cannot simply assume the right to disseminate another's content because we can view it directly or assume we have the right to share something that we were not the intended target for. Even without knowing the performer's true name, it didn't take 5 seconds to find it out because we brought up the fact he has a porn name, a porn studio, and has a face book account.
