Sorry, you're not married anymore

Well that is pretty shitty... what if your state recognizes same sex marriage but your federal government does not?
 
Then I think you're okay Jayhawk. But you might still want to see your state department (here Provincial Services).
 
Everywhere I've read about this today, people are outraged. Even the nuts calling into right-wing radio stations are talking about how absurd it is. Beyond the injustice to gay people, it also has wider consequences for other marriages. If a Christian and a Muslim were married, and the Muslim was originally from a country where such a marriage would be illegal, that too could be considered illegitimate.

This has been a huge misstep for the Harper gang.
 
I didn't even know this was in the works. Of course, there's no problem with all the 'normal' couples coming across the border to get married in Niagara Falls, Ontario. Their marriages are still sacred.

I can't see this being good for Harper, even if he has a majority.

One of the comments in the article mentioned all the money the government collected for the marriage licences and such and were wondering if it would be returned. I wonder about that as well.
 
I'm just scared that his next step will be to erdicate Canadian same sex marriages. Frankly, nothing's coming between my husband and I.
 
I honestly don't think that will happen FanofFiction. I genuinely believe Harper doesn't see anything wrong with gay marriage. It's a settled issue as far as he's concerned...as it is for the rest of the country. He just appointed an idiot and now it's biting him in the ass.

It will be fun watching this play out over the next few weeks.

I'd say that could be a stretch, but I do think he knows it's not a political or legal battle he can win.

This is the second same-sex marriage issue on the radar. There is another case in which government lawyers are arguing that British civil partnerships are not equal to Canadian same-sex marriage, and therefore cannot be legally recognized as such. Also out this week is news that a Tory back bencher is looking to open a discussion about the rights of unborn children (aka the abortion debate).

I fully believe that Harper will not jump into either of these debates: same-sex marriage would surely lose in the end (thank you, legal precedent) and a new abortion debate is about the easiest way one can commit political suicide (for all his faults, Harper is certainly not stupid). That said, though, I think these are deliberate maneuvers. The PMO has such intense control over the Tory caucus that by not suppressing these discussions (especially the abortion one, which was a deliberate release to the media) they're essentially endorsing them.

I wouldn't be surprised if this is their way of testing the waters on social conservatism, just to see the reaction. It's still early enough in their mandate that the political memory largely won't remember this in 2015, so it's a pretty safe gamble in the long run. I'd bet that most Tories don't even think they have a chance of any of this happening: the creation of an Office of Religious Freedom signaled that the Tories are looking for new ways to engage conservative religious voters.

In any case, I still don't regret voting Conservative last year, but I doubt I'll be doing it again.
 
You make some good points Aaron. Harper is the most wily Prime Minister I think I've seen in my lifetime. It's hard to make out what he's up to. And as you said, he has a pretty tight hold on the party and what it communicates. It could very well be deliberate on his part.

Nonetheless, I think they'll find there's less social conservatism out there than they're hoping to find.

Yes, but when we got married, we lived in Los Angeles. And the idiot lawyer who made this argument said it was "place of residence."

My understanding is that this is an archaic law that was really intended to say that "if you are legally married in your own country, you're legally married here so you can't move to Canada and marry someone else."

Or something.

Nobody's marriage is in danger.

My home country is America.

I live in the US. I'm an American-Candian dual citizen with residence here. In America.

I have no Canadian residence and although I have citizenship, I don't pay taxes there anymore and I don't have property or a job there.

Nor does my husband.

And the legal filing said nothing about country of birth or citizenship, it said "place of residence."

And that's Los Angeles, California.

The federal government is considering changes to the law that will make it easier for foreign same-sex couples who married in Canada to obtain divorces, Justice Minister Rob Nicholson said Thursday.

Nicholson also stressed the government has no intention of reopening the same-sex marriage debate after a day of confusion over the validity of marriage licences issued in Canada to same-sex couples from abroad.

Ottawa was pressed to clarify its position on gay marriage after an apparent about-face on the issue surfaced in a Toronto divorce case.

A lesbian couple who married in Canada seven years ago and recently filed for divorce was told by a Department of Justice lawyer that their marriage was not legal.

The stated reason was that because the partners live in Florida and England, where same-sex marriage remains illegal, their Canadian union was invalid too.

The case threw into question thousands of marriages non-residents entered into since 2004, when same-sex marriage became legal in Canada under a Liberal government.

In a statement, Nicholson said the issue centres on dissolution of marriages performed in Canada.

Non-resident couples who marry here must live in Canada for one year before they can legally divorce. The lesbian couple at the centre of the controversy has launched a constitutional challenge of that provision in the Ontario Superior Court of Justice.

Nicholson said he will be "looking at options to clarify the law so that marriages performed in Canada can be undone in Canada."

If you live in some bumfuck backwater state that doesn't recognize homo marriage, then quite simply, for them, your marriage never did and does not now exist. No matter what.

This isn't about Canada not recognizing same sex marriage or ruining the lives of people from out of the country.

Canada's justice minister says all same-sex marriages performed in Canada are legally recognized and the government is working to ensure foreign couples married here can divorce if they chose to.

"Marriages performed in Canada that aren't recognized in couple's home jurisdiction will be recognized in Canada," Justice Minister Rob Nicholson said Friday in Toronto.

"I want to be very clear that our government has no intention of reopening the debate on the definition of marriage," he added.

The statement comes one day after it was learned Justice Department lawyers were arguing a foreign lesbian couple that married in Canada could not apply for divorce here because their marriage wasn't valid.

Nicholson said the Divorce Act will be updated so those couples can apply for divorce in Canada if they feel the need to.

"I want to make it clear that in our government's view, these marriages are valid," Nicholson said.
