Sperm Donor sued for child support

I've never been able to agree to donating sperm and waiving my parental rights and I've been asked several times if I would do that. I just can't. I have a lot of respect for people who can do so, and who help but this recent US case makes me wonder just how binding a legal contract can be if the state can chuck it out over a loophole.

A US sperm donor is being sued for child support costs by a state agency for helping a lesbian couple conceive a child.

The Kansas Department for Children and Families is seeking child support from Topeka man William Marotta, 46, who donated sperm to lesbian couple, Angela Bauer and Jennifer Schreiner in 2009.

Would you be able to donate sperm to a couple to have a baby if you were not going to be a part of the child's life?

The couple had nothing to do with the lawsuit. They had a legal and binding contract absolving the donor of all responsibility. It is the state which has filed the suit, overriding the contract and virtually voiding it. If the state wins this suit, it puts all contracts in jeopardy if a state can say, "Nope. Never happened."
 
that's messed up. the state is basically punishing the man for donating sperm to the lesbian couple. bet they wouldn't care if it was a straight couple.

The article states:

The department is seeking about $6,000 from Marotta for financial support already provided by the state to Schreiner, as well future child support.

So I'm assuming that the couple have been on some sort of State assistance program and the State is going after the donor because they don't view the binding legal contract as valid because the donation wasn't provided to the Dr but directly to the couple. It's all in the article.
 
Well I don't know the law well in this regard... even if one contractually waives all parental rights/claims/etc., is it within a given state's right to still come after you for child support if the child winds up on social services and such?

For all I know that's perfectly legal.. dumb, but legal.

To answer the original question: I don't like children, so no, I wouldn't donate my sperm.

Now that I think about it, isn't it illegal to offer or sell parts of your body on Craigslist? Isn't sperm part of a man's body?

that scary thing is there's actually been dead guy's whose sperm has been taking after death and used to impregnant women. :cry: that's some scary shit. not even dead men are safe.
 
Genes don't make you a father... parenting does.

If he never took the role of a father then it's ridiculous to ask him for child support.
 
I could see my self donating sperm so that someone else can have a kid. I dont really want one but i would like to pass on my genes and maybe be the godfather.
 
I think it's best to either be a anonymous donor or simply be the father. Some middle way might end up with some complications later.
