It is illegal only insofar as it is applicable to a $200 fine. Not hard jail time.

The fact is, again, that he openly declared his business and paid his taxes on the sale of his product. The government, our own revenue service (the Canadian IRS, for you Americans) accepted his money year after year. He owned a freekin’ storefront, for gods sakes. It isn’t like he was peddling his wears out of a dark ally. Given the fact that he was a high-profile (pun intended) activist, it isn't like he was trying to dupe the government.

If that isn’t cause for a contest of the Justice Minister, I don’t know what would be. But Harper didn’t.

Again, it is downright bizarre for a nation to hand over a citizen to serve hard jail time for something that A) it completely overlooked and abided by and B) is only punishable by a joke of a fine, not even amounting to a legal slap-on-the-wrist. That was my point.

I was considering this on-topic due to the nature of the threat, in that America throws its weight around with Canada and any other nation it can get its hands on.
 
And I say that as someone totally okay with decriminalisation. But his business was against the law here, and against the law there, even though he thought the law was wrong.

So, how many Americans who also broke the law by buying the illegal seeds are going to prison, too?
 
I believe Noah should have been returned to Canada immediately, but there are facts that aren't being reported here:


1. The mother, Lisa Kirkman, went to Oregon with her two kids to visit the stepfather, John Kirkman. She left Noah behind (the court says "abandoned") with John, who suffers from the neurological disease myalgic encephalomyelitis (chronic fatigue syndrome).

2. Noah was not being supervised, I suspect because John was too ill to do so. The kid was playing alone in an industrial park (dangerous), and riding his bike on a very dangerous highway, Highway 58, infamous for fatal accidents (obviously dangerous).

3. Noah has a long case file in Canada and has been in and out of foster homes there, so it's clear he's not in a stable home with the mother. He also has ADHD and ODD, and should not have been left alone with a sick stepfather who couldn't care for him. Quote from the article:

Leonard said Friday that her leaving Noah in Oregon was not "for the right reasons. It was an example of extremely poor judgment on the part of Ms. Kirkman," he said.

4. Noah was doing well in Oregon. He was on fewer medications, getting good grades, and he didn't want to go back to Canada or stay with his mother.

I was expecting information like the above to come out, after all the "America is crazy" bullshit of course.

was he a citizen? I don't understand why he didn't just get all the help in his home country.
