IMO, I think that the sail technically violates the U. S. flag code published by the DOD and issued thru the armed forces. It doesn't have any "legal" standing; however, it has been used in the past to prosicute protesters who burn a U. S. flag. There are too many examples of t-shirts, caps, decorations, wrapping paper, underwear, etc. that utilize the flag in their designs.
"Do not use the flag as a portion of a costume or athletic uniform. Do not embroider it upon cushions or handkerchiefs, nor paint it on paper napkins or boxes.
Take every precaution to prevent the flag from becoming soiled. It should not be allowed to touch the ground or floor, nor to brush against objects.
