Yes, parody for art is not the same as parody for profit. The product is selling for $20, which probably wouldn't happen without the JD brand recognition. Interestingly, at least one justice didn't get the joke. On the other hand, dog toys have been made in the image of recognized products for decades. Not all of the toys in that company's line go so far in possibly offensive content -- they're just silly. This one might be questionable.

Trademark product owners should have the right to protect their image from being hijacked in the name of parody. Some may not mind marginal or innocuous use, but it is truly their judgment call, and those who sue are within their right to object after they have built up a brand on years of shaping its image.
