There were a bunch of Federalist Society members who were run through the judicial confirmation process in the waning hours of the Trump Administration. This judge was one. She was promoted by Florida Senator and cryptkeeper look-a-like, Rick Scott.

"Special Masters" are usually appointed when an attorney's office is raided in order to prevent confidential attorney-client correspondence from included in the evidence. Trump is not an attorney. She also cited "executive privilege" which would be something that would apply to Biden, not Trump. The materials seized belonged to the American people, not Trump.

It's another opinion that I suspect is going to be appealed and overturned because it was so badly written.

The craziest part of course is that the DoJ will have to appeal because of the stunning overturn of process this would represent...so it may delay...but cannot prevail.

Not even in a Trumpist, Federalist Society Supreme Court.


Because it would literally demolish the entire system.

And penned by a jurist that the ABA cited as 'unqualified' for her appointment.

Knowing a number of American jurists as friends....I can only imagine their apoplexy over this ruling.

But is it the victory Trump thinks it is? Nope.

His team and this judge have acknowledged in fact, that Trump is in possession of highly classified documents and has mishandled them.

Let the indictments flow.

It's a small detail but I think her ABA rating was "qualified". If you look at her background, she was from a family that fled Cuba and they had sufficient means to get her into Duke for undergrad. She clerked for an appeals court judge. She was an assistant US attorney.

And yet, she released an opinion that is so incoherent and twisted into a pretzel to accomplish what Trump's attorneys were asking that I don't think her career will ever recover.

The opinion is so bad that even Bill Barr is out doing interviews saying it was "wrong" and "deeply flawed" and that the DOJ should appeal it. About the only legal experts who are agreeing with the opinion are the ones who have Jeffrey Epstein baggage in their past.

Attorneys are like high school mean girls. When a judge, especially a Federal judge, blatantly ignores legal precedent and makes up new shit that doesn't have any sound legal backing, they get a reputation. This isn't like State courts where judges are elected and alcoholics and penis-pumpers are tolerated.

Federal judges with bad reputations as jurists also don't get the cream of the crop in law clerks from Ivy League schools. She'll end up with the clerks from Liberty University who can't find a spot in a real Federal Court. I suspect some of the more dubious Trump appointees (like Judge Mizelle who had never tried a single case in a courtroom) will end up with the same reputation.

And of course, today, WaPo is indicating that Trump had documents pertaining to another county's nuclear capabilities.

And yet he is still a free man.

There is some buzz though that this was leaked by DoJ to soften people up for an actual indictment of Trump in the near future.
