I expect that the DOJ made that decision quite some time ago and submitted it to the judge at the very last minute so Trump would have less time to argue about it.
 
It was the civil suit he lost. It's a lot harder to say he was acting in any way but personally when defaming a private citizen upon whom a court has found him liable of sexually assaulting.

Of course, the DOJ was probably forced to take that position in the first place.

Former President Donald Trump received a target letter from special counsel Jack Smith in the January 6 investigation but his former attorney, ex-New York City Mayor Rudy Giuliani, evaded a similar fate after meeting with prosecutors.

Giuliani has not received a target letter, his attorney told CNN's Paula Reid, and he does not expect to be charged after he completed a voluntary interview with special counsel investigators several weeks ago.

That pretty much tells you who didn't rat out Toad. If they are getting indicted, they'll get another chance to sell out it's leathery orange hide. Of course, the FED won't tell us who got the letters until the charging decision has been made, and inevitably some people got the letters and then showed up at the Grand Jury.
