If the 'Pubs ever went to Toad and told him to walk away, he'd start with the people who said it and send the trogs after anyone who agreed - politically and physically. NO ONE gets to win but Toad.

I don't think it's about politics or policy, or donors or cash, or anything remotely normal anymore. What they are looking for is an opportunity to fuck over everyone different from them. They have been conditioned by Ronna and her ilk to think that the Gubmint is the problem, so they might as well end it. She can pile up all the cash she wants, but unless she gives it all to Toad, they will NOT follow anyone's lead to vote for someone else over prospects or policy. They will not abandon Toad. Ronna had better get used to that.

Nothing would make Toad start a third party faster than Ronna supporting someone else. Toad won't care if he's not on the ballot in key places, he won't care if there is no realistic path to win - he'll just invent one in his cray cray, then attempt another coup. Toad will not forgive any 'Pub who tries to make him see sense, he will not care what donors are after or the policy they pay to forward. All Toad cares about is Toad, and all the horde wants is to ride his coattails to race war and beyond.

It is also worth noting that it was a 4-3 decision in the Colorado supreme court...meaning that it was hardly viewed as a slam dunk even at the state level. The question will be what weight will the Roberts court...already in the bag to deliver a Republican executive branch that will give them the absolutist power they crave to re-shape the country into the oligarchy their owners crave...give to the dissenting opinions.

Originalism appeals to conservatives because it has the same sociopathic tone as Ayn Rand's Objectivism. "Yes, guns and crimes involving guns are a problem in the US but we're not social engineers, we're judges, so we'll change the historic interpretation of the 2nd Amendment to put even more guns into the mix, because 'hey, that's what we say the Constitution says'".

There's a whole host of issues where the Originalists have claimed "That's not what the Constitution says": abortion, gay rights, voting rights...

If the Originalists suddenly decide that the 14th Amendment doesn't say exactly what is says, then it will just prove what many of have been saying all along: that Originalism is a bogus legal philosophy that equates to "the desired ends justifies making up the means and calling it a legal philosophy".

Former President Donald Trump was recorded pressuring Michigan canvassers not to certify the 2020 presidential election, the Detroit News reported Thursday....

RNC Chair Ronna McDaniel was also involved in the call, the Detroit News reported.

“If you can go home tonight, do not sign it. ... We will get you attorneys,” McDaniel reportedly told the two canvassers.

“What I said publicly and repeatedly at the time, as referenced in my letter on Nov. 21, 2020, is that there was ample evidence that warranted an audit,” McDaniel, a resident of Wayne County, told the Detroit News in a statement. She did not dispute the facts of the call as outlined.

Former Speaker Newt Gingrich (R-Ga.) suggested in a Thursday interview that the 14th Amendment should not apply in any modern situations, as he railed against the Colorado Supreme Court’s decision to
block former President Trump from seeking public office.

In a radio interview on “Cats & Cosby,” Gingrich made the case that the 14th Amendment only applied to situations related to the Civil War, pointing to the fact that the text of the Constitution never “references anybody today.”

Clearly this is a case they would rather avoid. Given the founding fathers view of King George any originalist interpretation of the Constitution cannot declare that the president is above the law and should they do so it’s not because it’s part of our ‘history and traditions’ It’s because they are highly political. In the NYT story on the courts abortion decision both Barrett and Kavanaugh didn’t want to take case just then preferring to wait another term, timing is a political consideration. We are doomed if future presidents are truly above the law.
 
Oh no question that if the SC rules for presidential immunity, the American experiment is truly over.

Donald Trump on Saturday night urged a federal appeals court to dismiss special counsel Jack Smith’s criminal case against him for seeking to subvert the 2020 election, contending that he is “absolutely immune” from the charges because they related to his official duties as president.

In a 71-page opening brief filed with the D.C. Circuit Court of Appeals, Trump’s attorneys said the prosecution’s charges primarily focus on his efforts to lobby state and federal officials to reverse the election results, actions that they claim were within Trump’s official responsibilities to ensure the 2020 election was conducted fairly.

 
Let’s hope the D.C. circuit is quick with their negative response.
