Birx doesn't deserve do-overs or excuses for that day in my opinion.

It was just one moment in her enabling a failed strategy for limiting COVID deaths and cases.

Granted, it was the moment when I think we all understood just exactly what a disaster the Trump strategy was and how it got that way.

He has to lose two conservative judges to lose the immunity challenge.

This case should never have gone to arguments. The fact that it has sets the stage for a Trump win in the courts and likely in November.

My suspicion is that the Court will rule in such a way that makes it clear that Trump has immunity but Biden and any other Democrat president does not in another Roberts' Court pretzel rulings.

They are going to quibble; they will say that no, there is no absolute immunity, but there may be limited immunity. Then, they will send it back to the first court to apply whatever test they say has to be applied where it begins a new journey back up to them, pushing any trials down the road to at least spring 2025 at the very earliest.

Toad is actually arguing in front of the SC that assassination may be covered under presidential privilege.

The level of despair just making that argument in the SC inspires is massive, not even mentioning the actual chance that the SC will agree.

This whole episode is absurd. Toad is trying to get the SC to say to the country that what Toad says is law, not the Constitution. The fact that any of them would agree is fucking depressing.

It's not the vote that we need to worry about. The problem would be if they spend the next 60 days crafting a means test to determine whether a Presidential action qualifies. That would be remanded back to the lower level courts and then start the whole appeals process over again.

The best thing that they could do is immediately lift the stay pending a final opinion and then avoid some Solomonic decision about what constitutes a "private" non-exempt action versus an "official" exempt action.
 
It is why I think that the Trump Court was already in the bag for him. But it will likely be a bare split decision so that some of the most morally troubled could vote against, knowing that the GOP majority will carry his water for him and don't give a shit about their future place in history because getting the White House for their owners is their only task.
