That's the scenario I dreaded in post #3,613.

There was a point yesterday where Justice Jackson was trying to make the point that the Court is supposed to hear and decide on the question before them... the same "oh, let's change the question to the one that we want!" stuff that conservatives used to accuse the the "activist Supreme Court" of doing back when they didn't have a 6-3 majority. Jackson asked the question but Gorsuch and Alito kept interrupting her questions to change the subject.

The question before them is, "In the DC District Court case, does THIS former President have universal immunity?". The question they want is, "If in the future, there might be some former President who does something that the next President doesn't like. Does the former President have legal immunization for any actions that he takes while he was the President?", as if this were some sort of law school rhetorical scenario...

All the conservative justices were acting squirrelly with the exception of Justice Barrett but I thought the worse was Sam Alito. While others threw out hypotheticals not involving the case at hand Alito’s hypothetical wasn’t all that hypothetical in his view as he posited the question what if after a president leaves office his political rival goes after him. If we didn’t know before we know now that Alito believes all these cases against Trump are political in nature and there is no legal basis for them.

To him and those who agree with him I don’t see how they can toss the classified doc case in with the others. Trump was clearly defiant in his behavior and lied about the docs. Nothing political it’s just legal.

Also yet again I was impressed by Justice Jackson, she has become a fav of mine and I think Alito hates her.
 
They will just invent any shallow pretext, barely bothering to refer to the law, safe in the knowledge that they are beyond accountability.

Nothing can be done to hold them accountable since Congress will never impeach any of them or even insist on an actual code of ethics.
 
I could dig up any number of posts in threads from 2015 and 2016 where I kept trying to make the point to the Bernie Bros. that it wasn't about the Oval Office...it was about the judiciary. The entire strategy of the far right is predicated on having an unaccountable Supreme Court to do their bidding, including the destruction of democratic institutions and downstream, of having conservative federally appointed judges who will make their work easier for them.

Their plan has worked out beautifully.

Let's face it. The GOP is being led around by a ring through their dick and they are determined to reinstate Trump mostly in revenge for his defeat, much as his own motive is simply to prove he wasn't a loser, or isn't.

The majority of his supporters know good and well that he has lied about all the facts and that he has repeatedly broken the law as president. They simply don't care. It's win at all costs.

Family values no longer matter. Pro law enforcement is no longer important. Supporting the military is no longer important. Opposing the Russians is no longer important. Fiscal conservatism is no longer important (the deficits Trump demanded were astounding.)

And most of the independents are simply disaffected Republicans, or Libertarians, so are never going to vote Democrat. Too much is being made of their postential support for Biden.

So, we could have Trump convicted, sentenced, and even in prison, but still be elected. And Congress is too chickenshit to pass a law to prevent his serving.
