US House just passed an Unconstitutional bill?

^^ I agree that the political class's feeble attempt to show us that they feel our pain is unconstitutional and I can only hope no one is fooled and remembers come election time.
 
Even though this situation is a hot mess, the House should refrain itself from passing unconstitutional laws. This whole damn stimulus mess should have been better laid out. Here we have AIG running away with government money and incapable conservative Southern governors rejecting stimulus cash constitutionally because the Obama White House was in too big a hurry to perform the miracle of the century, and its become such a tangled mess it will take industrial scissors to cut loose. AIG needs to be left to sink and the people of Texas and South Carolina need to call out their governors for incompetency. Why is ineffective politics still running this country?

IIRC so long as the tax year hasn't ended, Congress is free to keep adjusting the rules, so even if the income has already been earned, since the tax on it isn't due until the next year, such laws don't count as ex post facto.

The bill of attainder hurdle is a lot tougher to jump here, though.
 
They do it all the time. That is why we have the Supreme Court.
 
Seeing how none of the people on this forum are one of the 9 sitting Supreme Court judges, your opinion on the "constitutionality" of said measure is laughable.

I agree. I don't expect anyone in Congress to be a Constitutional law scholar. Based on the range of expert opinions, it seems like the passage of this bill did not involve entirely unconstitutional actions. That's why we have 3 branches of government. Let the Legislature legislate; let the judicial branch do their work.
