Virginia's Marriage Cases: Victory Near

The Marshall Newman amendment was so thoroughly based on hate and greed and lies, the judge had a lot of material to write about.

We now have a fourth hard hitting opinion post-Windsor, and another circuit will be hearing an appeal that might be ready for the high court in October.

No kidding, Bob Marshall made no attempts whatsoever to let everyone know his bill was about moral disapproval of gays and lesbians.
So glad to see it come back to bite him.
On a minor note, the judge made one error by getting the Declaration of Independence and the Constitution mixed up in one of the lines.
Doesn't take away from her kick butt arguments but still a little embarrassing I would think.

Second judge ponders Virginia’s same-sex marriage ban

U.S. District Judge Michael F. Urbanski asked lawyers at a hearing in Harrisonburg whether he should put the case in front of him on hold. U.S. District Judge Arenda L. Wright Allen ruled last Thursday in a separate case filed in Norfolk that the law violates constitutional protections of due process and equal protection.

...

Urbanski said he would make his decision “in due course” but would not hold oral arguments either way. The lawyers agreed arguments were unnecessary and said Urbanski could rely on briefs in his own case and arguments made before Wright Allen earlier this month if he decides to rule on, rather than postpone, the case.

Makes sense, if there is already a ruling on this, kind of a moot point to do another one from the same state.
I guess it might make her points stronger though.

I think two independent opinions will definitely reinforce each other. Urbanski is expected to rule very soon. As it is we have been on a winning streak in 12 gay rights cases since Windsor!

And I think that streak will continue. I think the judge in MI wants a full trial just to get all the facts out there before he strikes the ban down, same thing in PA.
As for Oregon, that ban is doomed. Not only is the AG not defending it but OR acknowledges same sex marriage performed in other states.
Going to be hard for the anti-side to explain why a ban should stay in place in light of that.
Many businesses are on board with this repeal because they are tired of losing business to WA and CA.

Umm yeah, the judge in Oregon is a gay Obama appointee. You call that one

Judge Walker was gay and yet his nomination was blocked for years. People forget he ruled against the founder of the gay games and put a lien on his house as he was dying of AIDS, something that did NOT endear him to the gay community at all.

We didn't know he was gay until a year after the Prop 8 trial. He was blocked for being associated with Republican politics. Yes he was also notable for suing the gay games in which he represented the US Olympic Committee.

Indeed he was which made it even more laughable that the bigots claimed he was a bleeding heart liberal.
