Asked if they intend to sue Wal-Mart, Paolucci said he and Hitchcock probably won't because other attorneys have advised them Wal-Mart historically "plays hardball" and isn't prone to settle cases out of court.
"We could spend a couple million dollars to sue them," Paolucci said.
But that doesn't mean there won't be court action. Paolucci and Hitchcock e-mailed The Tribune a copy of a letter from a law firm representing Wal-Mart seeking 10 times the retail price of the items the store still claims were shoplifted by Paolucci. The letter states the matter will be dropped if Paolucci submits the $158.40 payment.
The couple said they won't pay it, and should civil action result, they'll fight it.
Its bullshit big corporations can get away with this shit just because they will drag it out for years. There should be ACLU type organizations to help people with this as well as laws that help the people and not big business.
Kind of the same thing happened to me in April. I went into our local ER for a bad asthma attack and was admitted. The next day I left after getting fed up with their staff so the staff tried to stop me, but then let me go. An hour later I answered my door to two cops who were sent to take me back because Salem Hospital call them and told them I was suicidal.
Once the police paraded me in front of all of my neighbors and got me to one of their cars (there were four in total) they found I would not fit because of my disabilities and size. They told me they would call an ambulance since I was being taken “for health reasons” but the ambulance people wouldn’t come because they said it wasn’t medical. The police ended up kicking me and pulling me into the back of the car since they cuffed me so I couldn’t hurt myself they said.
I have been handicapped since 2006. I have a messed up knee, hip, lower back, and wrist. I also suppose to use a cane.
Once at the hospital I was put into the mental ward for holding. After an hour the ER doc let me go because he said I was fine mentally and never should have been brought back.
I came to find out the hospital only called me back to cover their own ass. Before I went in I was on a few meds. When they admitted me they stopped giving me my usual meds. One worked as a downer as a side effect. While I was there though they were treating my asthma with different meds which messed with my vitals so they gave me more meds. Almost everything they gave me worked as an upper. Basically the meds they gave me had the side effect of, if given too much, making people really pissed.
I spoke with a couple of lawyers and they all told me the same thing. Salem Hospital would keep the case going for years until I was broke and all they would have to do would be to raise the prices of some simple stuff they do to pay for their side. As for the police I was told juries would let them get away with it.
I had to go get checked out by my pain doctor after being pulled by my wrist, being cuffed, and have my legs being kicked on. He was pissed off. He had to up my pain pills for two months until my knee stopped swelling and having pain. He is also sure that the permanent nerve pain in my wrist is now permanently worse from having the cuffs so tight.
