What is new on the Gay Marriage front?

Awesome!!! That makes one more marriage-equality state I'll be going through on my way to Washington in a few months! I bet Oregon has a good chance of making that happen too, though I don't know if it'll happen before April.

Unless lawsuits succeed,it wont happen until fall,when the vote on whether to repeal the ban or not becomes law.

Or the Supreme Court refuses the appeal from the 9th Circuit, likely resulting in marriage equality in the remaining states.

A federal judge in Utah has granted judgment as a matter of law (summary judgment) in favor of the plaintiffs. The case is Kitchen v. Herbert. The state is almost certain to appeal to the 10th Circuit, but couples are apparently applying for licenses immediately!

A federal judge in Utah Friday struck down the state’s ban on same-sex marriage, saying the law violates the U.S. Constitution’s guarantees of equal protection and due process.

"The state’s current laws deny its gay and lesbian citizens their fundamental right to marry and, in so doing, demean the dignity of these same-sex couples for no rational reason," wrote U.S. District Court Judge Robert J. Shelby. "Accordingly, the court finds that these laws are unconstitutional."
 
I want to note this: From 1976 to 2004 and again in 2012, Utah was the No. 1 best-performing state for Republican presidential candidates. I'm referring to their margins. So this news is beautiful.

Underneath, it is still reasonable for a little known fact.

While we didn't expect this in the most Republican state, it is notable for one thing. Utah has the best ENDA coverage without it actually being state law - about 43% of the population actually. Up until now, all states with marriage equality passed ENDA first. In a way Utah fits the mold.

For that matter, Salt Lake City is a much more enlightened place than most of us would think. I've been there a number of times - it's never felt like a "backwater" at all.

The mayor has agreed to stay up all night to serve the gay and lesbian couples rushing to get married. There is a good chance that the 10th Circuit will freeze it as soon as it gets the emergency appeal from the state.

I saw this earlier and was blown away. It's great when a judge makes up his mind so much faster than his self-imposed deadline.

Right, well we expected that summary judgment would be denied here. If it was, there would have been a scheduling conference for the 7th to discuss a trial date.

Of course. The appeal has already been lodged though.

I was quite amazed to see this happen so soon as well. I sincerely thought Utah would be among the very last of the states (along with MS, AL, TN, OK, KA, KY, somewhere up there) to get marriage equality. I'm not surprised to see the governor attempting to stay the ruling, and I've heard the Utah county clerk is refusing to issue licenses - but for same-sex marriage to have been possible in Utah before other places like Oregon kind of surprised me!
