What is new on the Gay Marriage front?

From my understanding, Alabama's ban has been struck down altogether which means couples can marry Monday if no stay is put in place.
As for the Georgia case, that judge will rule against us, I'm surprised he hasn't already.
 
My reading is in agreement with Ninja.

Whether the Clerks offices will open up and issue licenses remains to be seen. But to refuse is to be in violation of a Federal court order.
 
I just posted a Wallace comment in another thread, it's entirely possible that some Southern, OR other bagger will fall upon his sword just for the drama of it.

I'm sure the counties with high populations will issue licenses, while some may drag their feet waiting for "clarification".

I fully expect for the Georgia case to be put on hold due to the judge not wanting to issue a favorable ruling. They will likely be dragged into it with a positive ruling from the 11th Circuit though.
 
The plaintiffs have requested clarification from the judge in regards to the probate judge's statement.

Montgomery and Jefferson (Birmingham) counties have announced they will be issuing licenses tomorrow.

This is the first judge to seemingly order the entire law struck down based on out of state married plaintiffs whom did not seek to be married in Alabama, and actually the authority for the judge to do so is questionable and not likely to survive appeal. For the time being it will be nice to see some offices open.
 
If he's a Federal Judge ruling based on the Federal Constitution and its precedents, it will take a Federal Appeals court or higher to stay his ruling. Given where the nine old men and women have been or been noticeably absent, I don't know if a stay will be forthcoming or not.

But, yes, it will be nice to see some offices open and some weddings taking place, even if for a day - that's what happened in Indiana, and look where they are now.
 
The judge in Alabama has stayed her ruling for 14 days, likely so the situation between the probate judges can be resolved.
 
I'd say that if this isn't stayed there's no way it could mean anything other than there are five votes to overturn the 6th. Hopefully, we'll see a quick punt out of the 11th to SCOTUS.

Well that's what we saw happen in Florida, only in this case the plaintiffs didn't experience the injury of having a license refused (as least as far as I know), which is normally required for the ban to be completely struck down.

The state supreme court should hope that this settles it so they can get let off the hook. I wouldn't be the least bit surprised if this was deliberately orchestrated.

It is going to be a very difficult vote for them especially at this time and so soon before a predictable SCOTUS outcome vs. the politics of Arkansas judicial elections.

Indeed, and I'll say this.
The Arkansas Supreme Court simply shows once again how absurd it is to elect judges.
 
Arkansas is still one of two states that have married couples during an open window without a final resolution; the other one is Michigan. It would be in Arkansas' interest to settle this case in favor of the appellees as soon as possible.
