What is new on the Gay Marriage front?

Gov. Snyder: Michigan Will Recognize About 300 Gay Marriages

Michigan will recognize more than 300 same-sex marriages performed during a brief window when they were allowed last year, Gov. Rick Snyder announced Wednesday [February 2, 2015].

The Republican governor said he will not appeal a federal ruling last month that the state must recognize the marriages. U.S. District Judge Mark Goldsmith said the marriages are valid but put on hold his decision for 21 days pending any appeal by the state.

I'm so proud of my state for doing this:

Future generations need permanent reminders of how hard we fought for our freedoms. I know we have social media to tell much of the story but the symbolism of this is just awesome!

There's a good-sized open space in the city limits (of the oldest part of the city, the original city) of Montevideo, Uruguay which is dedicated to equality for GLBT people! As some people remember, same-gender people can also legally marry in Uruguay (AND pot is legal)!** I'm not even sure that I've seen any other space anywhere which "commemorates" GLBT people in any way.

**As some have said, the Leviticus passage which says something like "If a man lies with a man as with a woman, he shall be stoned" takes on a whole new meaning, doesn't it? ..|

Presumably this will also require the state to recognize all foreign marriages which occurred on or before March 22, 2014, although it will likely take further litigation to clarify it (California did so after Prop 8 passed).

At best, ones that took place elsewhere during that exact same window. Don't hold your breath.

Alabama Chief Justice Roy Moore has issued an order to the state's probate judges NOT to issue any same sex marriage licenses on Monday. Moore has not threatened the probate judges with specific penalties; he says only that it is the responsibility of the governor to enforce the state constitution's prohibition of gay marriage.

Same sex marriage was to begin Monday in Alabama as a result of the 11th Circuit Court's rulings on January 23rd and January 27th that Alabama's ban on gay marriage violated the 14th Amendment of the US Constitution. Both of those rulings were stayed by the 11th until Monday, February 9. The 11th has refused to extend the stay. Alabama's appeal to SCOTUS to overrule the 11th and stay the decision has been ignored.

Roy Moore has said recently that states have a right to ignore federal laws which are inconsistent with state laws.

Our movement finally has its George Wallace moment. I expect many counties to ignore this and will likely push the Supreme Court to issue an official denial of the stay.

Pike County has announced it will not issue ANY marriage licenses (gay or straight) for the time being. Several other counties are following this example. They believe this approach will shield them from lawsuits for not issuing gay marriage licenses, but how long can they keep that up? Washington and Covington Counties have announced they will issue straight but not gay marriage licenses.

The probate judge in Jefferson County expressed surprise that Chief Justice Moore was challenging the federal courts, and the probate judge in Montgomery County expressed a desire not to repeat the mistakes of the civil rights movement in Alabama 50 years ago. But neither judge said that they would be issuing gay marriage licenses in their counties.

Gay Marriage Cleared by U.S. High Court to Start in Alabama
It comes in advance of a constitutional showdown that may mean legalization nationwide. (!)

The U.S. Supreme Court cleared the way for same-sex weddings to start in Alabama, letting the number of gay-marriage states climb in advance of a constitutional showdown that may mean legalization nationwide.

In a 7-2 order, the justices rejected Alabama’s bid to stop a federal trial judge’s legalization order from taking effect Monday. The state now will become the 37th where gays can marry. Justices Antonin Scalia and Clarence Thomas dissented.

The rebuff brings gay marriage to a state whose chief justice, Roy Moore, has told officials not to comply.

I'm shocked - absolutely shocked that Justices Scalia and Thomas would dissent!* (*S*)

*But they never can have children.

A small miracle is occurring in Alabama.

Many counties are ignoring Roy Moore's order from the Alabama Supreme Court and are issuing same-sex marriage licenses.

Of course, some counties are following Moore's order and not issuing same sex marriage licenses (or in some cases, any licenses at all). Predictably, Bryan Fischer of AFA is praising them.
