If the marriage is legal and can keep your partner legally stay, will you do that?

I have a Canadian friend who had been with his boyfriend for 3 years. He finally broke up with him because his boyfriend could not find a job there and my friend did not want to marry him. So he had to return to his country.

At first, I justified my friend's decision because I think it is a shame to obtain legal status through marriage if you two are not ready to get married. Then the meaning of this relationship changes to some extent.

But recently I changed my mind. The two had been together for 3 years and they lived together. Why cant my friend use a certificate to keep his boyfriend by side. Probably he did not love him enough but then why you kept him to yourself for 3 year?

To the OP -- I agree with your friend...

MARRY him if you want to -- but NOT for OTHER reasons...

And loki -- what would you have done on your wedding night???

:):):)

You cannot do that legally. A same-sex marriage is not recognized by the Federal Govt. for immigration purposes because of DOMA (The Defense of Marriage Act). Same sex marriages are performed at the state level, immigration and naturalization are handled at the federal level.

There are currently several bills floating around Congress that would remedy this situation, but the chances for them are slim especially given the fact that the HOR will be in Republican hands come next year.

If they lived together for 3 years in the same house co-habitated as it is then under Candian Law they are common-law spouses and the immigrant can apply in situ for Landed Immigrant status. The boyfriend would still be on the hook just as any married couple that gets divorced.

It would depend on the situation I think i read somewhere that as a sponsor and husband you would be financially responsible for your partner in the country... So it would all depend on trust I guess and the situation lol..

I'd do anything to stay with the one I loved....

.... if I actually had someone....
