Beyonce's 'B-Day' Hits Copyright Snag

Columbia Records is facing the prospect of having to pull the new deluxe edition of Beyonce's "B'Day" from store shelves amid a legal dispute over publishing rights. But rather than remove the release from stores altogether, Columbia parent company Sony BMG plans to manufacture and distribute a new version of the deluxe edition, minus one track featuring the challenged copyright, multiple sources say.

At the heart of the controversy is the track and accompanying video "Still in Love (Kissing You)," a new reworking of Des'ree's 1996 song "I'm Kissing You."

The Royalty Network Inc., a publishing company administering the copyright on behalf of Timothy Attack, co-writer of the song, alleges that Sony BMG didn't receive their permission to use "I'm Kissing You." It is pressing the matter by filing a copyright infringement complaint with the U.S. District Court of the Southern District of New York -- a move that has led to a temporary halt of distribution of the album.

Sony BMG, Sony BMG Sales Enterprise, Beyonce, her B-Day Publishing company and EMI April Music are all named in the suit.

A preliminary injunction hearing is set for May 4, which could require Sony BMG to permanently stop distributing the copies of "B'Day -- Deluxe Edition" and "B'Day -- Deluxe Edition/Video Anthology," a special Wal-Mart version of the release, and perhaps even remove unsold discs from store shelves. As part of the temporary cease-and-desist, "Still in Love (Kissing You)" has been yanked from digital services (though the rest of the album remains) and the "Still in Love" video has been pulled from video outlets.


Retail sources estimate that Sony BMG has shipped several hundred thousand copies of the deluxe editions to date. The editions, which include the top 10 Hot 100 hit "Beautiful Liar," a duet with Shakira, have sold 214,000 copies since their release at the beginning of April, according to Nielsen SoundScan.

Retail and legal sources suggest that the matter can still go away for the right price. But retail sources say Sony BMG seems disinclined to settle. The company has put the word out that the current version of "B'Day -- Deluxe Edition" is no longer available for order and that it plans to soon issue a new replacement version. The cost is expected to be minimal to Sony BMG, because most of the product that had initially hit stores has been sold and the company needed to manfacure more units anyway, sources say.

Reps for Sony BMG, Columbia and Beyonce didn't respond to requests for comment. Anthony Motta, attorney for The Royalty Network declined comment.
 
Uh, hell no. She needs to pull a Mariah Carey and go away for a couple of years.

BTW on the case, there is no "alleged" copyright infrigement, she did plagerize that singer Des'ree's song "I'm Kissing You". I've heard both versions and it is true.
 
God, Beyonce could sing about a bug crawling on her leg and the song would still reach the top 10, meanwhile she has to go and steal other people's songs? Lest we all forget she took the credit for writing songs on her album all by herself. Not very creative are we, B?

I bought the Deluxe Edition and it doesnt have that song, or at least the version that is sold over here.
 
A 3rd time? God she is milking her fans more than Mariah did with her multiple releases of TEOM.
 
They'll probly just re re-lease it again without that song or put in a new song. And if they put in a new song why buy it again when you can just d/l that song if its worth it.

People need to get over themselves. So her and her record company used the song. Big freaking deal. Des'ree should be happy she chose her song. Big companies look for ways to cause trouble. What about taking people to court for things that actually matter?

Seems the people taking her to court dont care too much not to get the video taken off one the worlds most popular websites that "everyone" knows about....

 
Desree should be happy........I dont think so. Not when you take a perfectly good song and make it sound bad.
 
Uh, it's copyright infringement, which is illegal. She sang someone else's song and made a profit off of it wihtout permission. You know, copyright laws are the reason why people can't make the same exact movie that someone else made and get rich off of stealing someone else's idea.

And as an added smack, Beyonce couldn't even do it well.
 
I went to check out new releases today, guess what, they already silently replaced it with the version without "Kissing You", I'm glad I bought both the CD and DVD a month ago.

she STOLE a song. she did NOT have permission to record it. and knew better not to release but she did it anyways.
 
The moral of the story then is to FUCK OFF FOR ALL ETERNITY or at least until she's learned to write decent songs. Whatever comes first, which will be the former.
 
Beyonce gets worse by the day. At least Des'ree is getting some great free publicity out of this. Romeo + Juliet soundtrack is great.
 
Personally, I don't think she's the main one to blame here. But that's because I don't think she deserves much of the credit for the album as a whole. She brings her vocal talents and skills (whatever you think of them) and her hot bod to the package. Maybe she has a bit of say in the selection of material. But a bunch of other folks are writing, recording, producing, mixing, and setting the whole thing up...so she can walk into the studio, lay down her vocals, and go home.

I'm not piling onto her, because I can't have it both ways. I can't say that she didn't do anything but sing on the album, but now it's all her problem when a copyright issue rears its head. But that should work both ways. Everyone who's been pumping her up, saying what an amazing talent she is and how much they love "her work"...shouldn't now be able to say this has nothing to do with her. Because, again, it can't work both ways. If you want to give her all the credit when things go right, you'd best be ready to hand her the blame when things go wrong, as well.

They didnt pull it off the shelves yet here in Baltimore. I was in a cd store tonight and they have the version with the song on it and when I ask the people that work there they said they are not taking it off the shelf. Even though they could of just said that.
 
Well, we shouldn't blame her like this for this one song, as a singer, she has a beautiful voice, and I LOVE her new album "B'Day Deluxe Edition", and that's all I want from her. Besides if the company just removed one song from that album, there's no need to buy it again.

We have the official release of the first version of "B'Day", but not the deluxe edition, I downloaded the newly added songs from the internet. And if the latest version is released in China, I'll surely buy it to support this one of my favourite artists.

There is a Taiwanese girlband here called S.H.E, they always sing foreign artistists' songs in Mandarin, they have covered Destiny's Child's "Brown Eyes", Britney's "Everytime", and even Westlife's "Soledad"...But there are still a lot of Chinese people who love them. I hate them, they're all bad singers.

So, to me, Byonce's copyright issue is no big deal.
